At about 7.20p.m on this Apil $tr,, 2025 some members of the media contacted Mr. Harrison Kinyanjui on a proceeding in respect of the aboz,e matter, before the Labour Committee ruhen Mr. Harrison Kinyanjui Adoocate's name and lau firm urere adaersely mentioned, ns they utere seeking to hatre our comments on the same. Mr. Kinyanjui utas utterly stunned, as there utas NO notice of any such allegations sented on us to respond to at any gioen time. Further note that the issue of Kenya Breweies Ltd compensating its former employees is pending before the High Court as SOME indittiduals seek to set aside the Judgement of Hon. lustice Sergon in NAIROBI HCC 2792.003 in which some persons haae hitherto made applications to hme the case leard afresh. The matter is therefo re sub iudice. (Please see attacheil Court CTS pintout of the same, for ailjudication of an application CURRENT as lodged by Namada €t Co. Adoocates representing some of the 6,000 Plaintffi). We also utish to bing to your kind attention the follotuing: 1. The fact is that there zpere alleged to be about 6,000 or so former employees of Kenya Breuteies subject of the said suit, some reprexnted by Gitobu Imanyara €t Co. Adaocates, some by Namada €t Co. Adoocates, and some by O.P. Ngoge €t Co. Adaocates in the pimary suit, NAIROBI HCC 279 of 2003. Some of the said Plaintffi left Gitobu Imanyara €t Co. Afutocates and sought representation from my law firm. They were in penury and I ffired to act for ONLY identifable Plaintffi from IvVS Gitobu lmanyara Adoocate. 2. About 125 of the said indioiduals approached my laur firm through the '[.'t-named Plaintiff, one Lautrence Nduttu to so reprexnt them in the cited suit. O.P. Ngoge €t Co. Adaocates were unhappy about this and when the matter utas called before Hon. Lady lustice Ang'auta she formally listed the said indiuiduals as being aligned under my lau' fm and those aligned und.er Namada €t Co. Aduocates separately. 3. Unhappy, O.P. Ngoge Adaocate sued my lau, fm as urell as Namada €t Co. Aduocates to appeal against a Ruling of the High Court dated 76th December, 2011 (Ang'awa, l) that hnd nllouted some parties joined in the suit as plaintiffs to be represented by the frm of lvl/s l. a o 2 a
a a o a a a o (t o 3 a t Harrison Kinyanjui €s Co. Aduocates, instead of W O.P. Ngoge €t Associates who were reprexnting all tlu plaintffi jointly. 4. NONE of the 12\Plaintiffs paid the cost of defending these proceedings. It was ALL at my outn cost, to secure justice for the said Plaintffi. 5. The Objection by O. P. Ngoge Adaocnte in the said proceedings was ooemtled by a 3 Judge Court of Appeal Bench of Hon. Mr. lustice Githinji, Warsame €t Musinga 01il by an Order dated 19tlt Nottember, 2013 in Nairobi Court of Aooeal Cfuil Application No. NAI 51 oL201-3. 7. Unl*ppy urith the Court of Appeal's decision against him, O. P. Ngoge Adaocate then lodged and Appeal in the Supreme Court. ztide Supreme Court Petition No. 13 of 201s My lau frm ans sued as the 3'd Re.spondent therein while the 4 in the Supreme C-ourt Appeal and the SAME parties I represent toere also sued and they entirely relied on my representation BEFORE the Supreme Court. 8. The Supreme Court DISMISSED the said appeal entirely by learned Counsel O.P. Ngoge. NONE of the 125 persons under Lautrence Nduttu paid my laut frm a SHILLING for that entire span of Supreme Court proceedings. To date. Can anyone allege that we "faileil to proaide anytladequate professional seruice" in this instance despite NO fee being remitted? 9. The stated decision of the Supreme Court uhich details the matter in extenso, including our representations before the Apex Court can be found here for aerifcation: Peter Odiwuor Nsose t/a O P Nsose €t Associates Adztocates €r 5379 others zt I Namada Simoni t/a Namada & Co Aduocates €t 725 others [2014] eKLR 70.1 appeared duing the entire Heaing of the High Court tial before the Hon. Mr. lustice Sergon, and they also did not remit the legal fee on the conclusion of the tial. No getting up fee of a shilling was remitted. 6. NONE of the said Plaintffi paid my ls71t f.rm a SHILLING to defend them in thc Court of Appeal in those proceedings. None of them could eaen lau,fully allege that u,e "failed to prooide any/adequate professional se'ruice" in this instance despite NO fee being remitted. 11. No one compelled ANY of the Claimants to execute the Discharge Vouchers which enabled payments of what they uere demnnding from Kenya Breweies. Mr. Larurence Nduttu zoas taslced by the Hon. Lady Jttstice Ang'arua with representing the Claimants hence Mr. Lautrence Nduttu by order of tlrc Court in tlu cited suit thus arranged for each of them to be

Kaplan I Strqtton Adaocates, nnd each of them executed the same. 12. Was ANY of tlrcm placed under the banel of a gun to execute the same, or tortured, or subjected to ANY form of duress of compulsion? Were ANY of them subjected to ANY form of coercion by myself or ANY employee in my law frm? NO!!!!! 13.They each ooluntaily and urithout any compulsion executed the same after being informed by Laavence Nduttu and myself of the contents and ramifications thereof. Their payments utere mode by bankers checks to EACH of tlum, collected by the persons indiaidually apart from one or two utho called our offce and categorically directed us to hnnd their cheque to Mr. Njigu or Mr. Lautrence Ndufu as the case was. This was also documented. 14. It was on the bases of these Discharge Vouchers that the pro-rated sums toere remitted to THEM. NONE of the said persons REIECTED the cheques, or euen receioed ANY of the cheques on a utithaut prejudice basis. 75. Notc that the indioiduals utere to receioe each according to their Discharge Voucher. As a Client binds an Adaocate to a commitment made urhich the Adaocate hns to abide by, these Discharge Vouchers are categoical and clear in their terms. Hout could toe be accused of ooerriding the same? 15. Each of the said persons under our reprexntation READ and UNDERSTOOD uthat the Discharge Vouchers stated BEFORE executing the same. 17. Mr. Laurrence Nduttu as indicated aboae was appointed by Order of the Hon. Iady lustice Ang'awa to sutear all depositions on behalf of the Plaintiffs under my laut frm and hence uthen he conoened the said persons and ALL mntters urere disclosed to the said persons NONE of them objected, or sought to be excluded, or othenuise remoaed themseloes from our representation. Hout then hnae ute failed to execute their uishes? '18. We then forutardcd each of the said duly executed Dischnrge Vouchers to Kaplan €s Stratton Adoocates by our letter dated June Sth, 2023. They cannot be heard to resile from tluir own commi tme n t s there in co ntaine d. 19. Note further that a Schedule of payments utas receiaed by *y law frm from Laurence Nduttu under a forurarding letter ftom an entity chistened "KEN-BREX SACCO GROUP" tohose signatory ttas Laurrence Nduttu as the ostensible chairperson. Tlw said communication utas indicating that I should pay ALL the 125 persons' remittances amounts to Equity Bnnk Ltd from my stated Client Account into which the dues had been mnde.
a a a o a a a o c 20.1 totally disagreed with that course of action as it ruas not only unlaurful but altogether fraudulent, and I immediately instructed Mr. Lawrence Nduttu to rectify the sums indicqted on the remittance Schedule should be to EACH of the 1.25 Plaintiffi I represent and I declined to remit any sums to the KEN-BREX SACCO GROUP stated Bank Account insisting thnt I uould pay each beneficiary through the Bankers Cheques. This is the genesis of ALL the malice by the said Mr. IAINRENCE NDUTU and a Mr. NfiGU. 21. Afier Mr. Lawrence Thoithi agreed to re-do the Schedule of payments he made an error in the fnal remittances so that he failed to factor into the schedule the bank charges of Ksh.300/= per Bankers Cheque as well as the Ksh.600,000/- to be retained in the said Client Account to cooer for the expenxs of tlu pending Appeal. This fact was knoun to l-awrence Nduttu and all the other Claimants I represented in the said Mntter. 22. To date, no one has utitten to my lnut firm (NOT euen Lautrence Nduttu) to complain that I haae in any manner misappropiated a penny of their funds. 23. It is important that I state that each of the returned Banl<er's Cheques utith the elroneous sums and of tuhich Lautrence Nduttu (as the lead person) had misspelt names attracted a fee of Ksh. 300/= drawn from the same Account. 24. I urish to state that payments agreeable to all the former employees of KBL whom I represented, were paid through Bankers Cheques. I must also state that I still hold in my posxssion some Bankers' Cheques drawn in the name of former KBL employees whom I was reprcsenting that are since demised, awaiting Grant of lttters of Representation which Lawrence Nduttu is fully aware of. 25.1haae NOT (I repeat: NOT) retained a SHILLING or any amount of the monies remitted to my stated Clients Account by IvUS Kaplan €t Stratton in respect of the settlement done under the stated ludgement, relating to this matter as I had the specifc Bankers Cheques drawn infaaor ofeachbeneficiary according to the listftom KBL Adaocates as cross chccked and aeifed by Lautrence Nduttu utith my Accountant Mr. Laurrence Thoithi. None of the persons on the list of the 125 Plaintiffs I represented hat-te claimed (formally or otherwise) that I haoe not paid any amounts to them under the said settlement. 26. I refer you kindly to paragraph 19 and 20 abooe to comprelund the context of the bitter allegations herein raised by the said persons. Surely, it is unfair that we should be dqiaed of the opportunity to demonstrate the sheer malice by this Lautrence Nduttu. 27. Adaocates on the 3RD Madr 2025 before the Hon. Iady Justice Achode, Mr. lustice Kiage and Mr. lustice loel Ngugi when the Appeal was withdraurn by thz said Laurence Nduttu. Enclosed is a copy of the Order therefrom. 31. How can we be blamed for this when Laurence Nduttu elected to chnnge adrtocates utithout the professional courtesy of informing us? We enclose a copy of tlw said Order. All said, we haae elaborately attempted to claify some issues germanc to the spuious allegations as ae haoe been made to respond to this issue 3 times now seParately, including urith the DCI, and the Adoocates Complaints Commission. With respect, these Complaints are leuied by only 4 or so isolnted persons because of their BITTERNESS af NOT pocketing the monies meant for their colleagues and the curtailing of the scheme to swindle their colleagues.
