PRELIMINARIES

ESTABLISHMENTANDMANDATEOFTHECOMMITTEE

The Standing Committee on Agriculture,Livestock and Fisheries is established under standingorder228(3)oftheSenateStandingOrders andismandatedtoconsiderallmatters relating toagriculture,irrigation,livestock,fisheries development andveterinary services.

In undertaking its mandate,the Committee oversees the following State Departments:

  • 1.MinistryofAgriculture and LivestockDevelopment-
  • i. The State Department for Crops Development; and
  • ii.The State Department for Livestock Development.
  • 2.Ministry of Sanitation, Water and Irrigation.
  • i. The State Department for Irrigation.
  • 3.Ministry of Mining and BlueEconomy and Fisheries.
  • i. StateDepartmentforBlueEconomy and Fisheries.

The Committee also oversees thefollowingStateAgencies amongothers-

TheFood andFeedSafety Control CoordinationBill,2023(National AssemblyBillsNo. 21of2023)seekstoprovideforthesafeguardingoflivestockfromadverseconditions including drought,provide for sustainablepractices to alleviate the effects of drought on livestock farmers and for connectedpurposes.The Billprovides for the sustainable developmentof thelivestock sector,shielding thelivelihoodsofits stakeholders,and fosteringresilience amongrural communities against drought and itsrepercussions.

TheFood andFeedSafetyControl CoordinationBill,2023NationalAssemblyBillsNo. 21of2023)wasreadforthefirsttimeintheSenateonTuesday,19thSeptember2023and thereafter theBill stood committedtotheStandingCommitteeonAgriculture,Livestock andFisheriesforconsideration.

Incompliancewith theprovisionsofArticle118oftheConstitutionandStandingOrder 145(5)of theSenate StandingOrders,the Committeeproceeded toundertakepublic participation on theBill.In thisregard,the Committeepublished an advertisement in the DailyNationandStandardnewspapersonFriday,22ndSeptember2023,invitingmembers ofthepublictosubmitwrittenmemorandatotheCommitteeontheBill.Additionally,the Committeesentinvitationstokeystakeholdersinviting them tosubmittheircommentson theBill.

In total,the Committeereceivedwritten submissionsfromfive(5) stakeholdersnamely: The Council County of Governors (COG),Ministry of Agriculture and Livestock Development.(MOALD),KenyaPlant and Health InspectorateService (KEPHIS),Kenya Veterinary Board. (KVB) and theKenya Association of Manufacturers (KAM).

Mr.Speaker Sir,

The Committeethereafterproceeded toconsiderextensivelytheprovisionsoftheBill and the submissions received thereon.Basedon itsdeliberations,the Committeehasmade variousobservationsassummarisedbelow:

Summaryof Committee Observations

CHAIRPERSONSFOREWORD

  • 1.TheroleoftheFoodandFeedSafetyControllerwillworkefficientlyifitis independentofferinga guidingrole in theperformance ofofficial controlsby competent authorities.Itis therefore,important that theofficeis domiciled above ministries so that theroleisnot left to one ministry;
  • 3.The submission of the annual reports is importantboth at theNational and at the Countylevel.The annual report should therefore be submitted by the Governor toboththeCountyassemblyand to theCabinetSecretaryso asto provide clarity in thehandling of the stateof food andfeed safety at both levels of government; and
  • 2.FoodsafetycutsacrosstheCountyGovernmentsandthecompetent authorities.Consequently, the Bill should factor in the role of the county governments in food and feed safety. The Committee noted that there is gap in clause 4 of theBill whichprovides that theActwill applyto competent authoritiesaslisted under thefirstschedule,theschedulehowever doesnot include the countygovernments.Noting that Countyhealth servicesare devolved,theimplementation of thisAct should therefore be undertaken by bothlevels of government;
  • 4.Thatamechanismshouldbeputinplacetofacilitateconsultationsbetween the Controllerand a competent authority or a countygovernmentininstances where an overlap occurs.

SummaryofCommitteeRecommendations

TheCommitteerecommendsthat theHouseapprovesthereporttogetherwith the following amendments: -

  • 1.That,clause4of thebillbe amendedtoprovideforthe applicationof theBill to boththe competentauthorities and thecountygovernments;
  • occursbetweentheController and competent authoritiesor thecountygovernments; 3.That,Clause22be amended toprovide thatwhere ariskis identified,thecontroller
  • 2.That,Clause 19 be amended toprovide for consultation in cases where an overlap
  • shall advise the relevant authority on steps to be undertaken to manage therisk; and 4.That,Clause 33onregulations beamended toprovidefor Consultation with the Council of County Governorswhen developingregulations.

1.1. Background

TheFoodand FeedSafetyControl CoordinationBill 2023,(National AssemblyNo.21 of 2023)waspublishedonThursday,21stSeptember2023andreada.FirstTimeintheSenate onTuesday,19thSeptember2023and thereaftertheBillstoodcommittedtotheStanding CommitteeonAgriculture,Livestock andFisheriesfor consideration.TheBill published isattachedtothisReportasAppendix2.

TheBillisanActofParliamentthatseekstoprovideforthecoordinationof thepublic institutionsinthecontrol offoodandfeedsafety;toestablishtheOfficeoftheFoodSafety Controller;toprovidefortheroleof County Governmentsinfood andfeedsafety;andfor connectedpurposes.

TheBill seekstoensure that thereissupplyofsafefood andfeedtoconsumers.Itprovides thatfoodsafetyisacriticalfunctionofboth thenationalandcountygovernmentsin fulfilmentofconsumerprotectionasprovidedin theConstitution.Itseeksto ensurethat food is safelyproduced,distributed,processed,marketed andprepared forhuman and animal consumption.Food safety is a criticalfunction of the national and county government infulfilment of theconsumer protection as provided in the Constitution.The Billwill ensurethatfoodissafelyproduced,distributed,processed,marketedandrepared forhumanconsumptionfromthefarmtofork.

TheBillfurtherprovidesforthecoordinationof CompetentAuthoritiesandprovidesfor the multi-annual control plan,theverification ofmechanisms utilized by Competent Authorities toenforcefoodandfeedsafetyrequirementsandfor auditsoffoodsafetyor feedsafetymechanisms.Itfurtherprovidesfortheconductofverification auditsandrisk analysesbytheController.

Most importantly,the Bill provides for traceability requirements and for reference laboratoriesforpurposesofofficialcontrol.Itrequires thesubmission ofreportsonfood safetyandfeedsafetytotheControllerandforthe appointmentofcomplianceofficers and thepowersofcomplianceofficers.It accordinglyprovidesforconsequential amendments to thePublicHealthAct,Food,Drugs and Chemical Substances Act,Dairy Industry Act, ReportontheFoodandFeedSafetyControlCoordinationBill,2023 1

CHAPTERONE

Fertilizers and Animal Foodstuffs Act,Pest Control Products Act,Meat Control Act, Standards Act,BiosafetyAct,2009,KenyaPlantHealthInspectorateServiceAct,2012, Agriculture andFoodAuthorityAct,2013,FisheriesManagementandDevelopmentAct, 2016,WaterAct,2016 andHealthAct,2017,toprovidefortheroleoftheController and for themulti-annualcontrol plan.

InKenya,foods for export or for the formal market are the only ones subjected to inspectionsand testing,yet more than80%of foodis traded in theinformalmarkets.It is for this reason that the CAADPreviewreport by theAfrican Unionranked thecountry poorly on the indicators that measure the impact of food safety on public health and trade.

Kenya misses a hugemarketof meat andmeatproductsin theEuropeanmarketbecauseit doesnothavea competentauthority thatisresponsible throughout thefoodchain to implementeffectiveinspection andguaranteecrediblepublichealth and animalhealth attestations in the healthcertificateto accompany meat andmeat products that are destined fortheEuropeanUnion.

Kenya has a history ofepidemic outbreaks such asRiftValleyFever,cholera and aflatoxin thatled tolossoflivesandeconomicdownturn thatwasmajorlyattributedtoinadequate measures to enhancefood safety.Furthermore,we donothave a functional food safety surveillance system,with onlya handful offood safetyprofessionalsand accredited laboratories. The multi-agency approach in food safety has become a hindrance in managingissuesowing to some overlappingmandates,lackofcoordination andunder resourcing.This hasled to agencies that don't implement their mandates,leaving food safetyissuesunaddressed.

Aflatoxin,highlevelshasbeenlinked tobad agriculturalpractices,lackofsensitization andinadequatedetection and surveillance.Farmersneitherhave theknowledgeof the dangersof aflatoxinnorthetechniquestopreventitsgrowth.Waterpollutantssuch as heavymetals,industrial effluent,agricultural inputs andraw sewage dischargein water bodies is a concern.Farmproduce inKenyan markets has been found to havehigh pesticide residues.

Furthermore,unscrupulouspractices by traders ofperishablefoodshavebeen reported in thecountrywithchemicalsused topreserve agricultural produce.DespitetheFood Safety Policy(2013)aimingforthecreation ofanintegratedfoodcontrol system,aNational Food SafetyAuthorityandtheharmonizationof agencymandates;noprogresshasbeenmade on these policy objectives.

1.1. Object of the Bill

Theprincipleobjectof theBill is toprovidefor thecoordination of thepublicinstitutions in thecontrol offoodandfeedsafety.ItestablishestheOfficeoftheFoodSafetyController andprovidesfortheroleofCountyGovernmentsinfoodandfeedsafetyinordertoensure the supply of safe food.

1.2.OverviewoftheBill

Theproposal contains 34 clauses and has the followingprovisions:

PartI:PreliminaryProvisions

Clauses 1 to 5of theBill provide for preliminary provisions,that is the short title, interpretation ofthe terms as used in theBill, objects, application oftheBill and the guiding principles.

The application clause provides that theBill shall apply to everycompetent authority.

PartII:OfficeoftheFoodandFeedSafetyController

Clauses6to9of theBillprovideforestablishmentof theOfficeoftheFoodandFeed Safety Controller as a bodycorporatewithperpetual succession,commonseal and capable ofsuing and being sued,acquiring and disposingproperty andperform such acts asmay be performed bybody corporates.Itprovides that the Office of the Controller shall be designated asaState Office.Italsoprovidesfor theappointmentof Controllerbythe Presidentwith the approval of National Assembly and the qualifications andfunctions of the Controller.

Clauses10 to15oftheBillfurtherprovideforvacancyin theofficeoftheController, removalfromoffice,staffoftheOfficeoftheController,remunerationoftheController, delegation by the Controller and protection from personal liability.

PartIlI:FoodSafetyandFeedSafetyby CountyGovernments

Clause16oftheBill providesfunctionsofcountygovernmentinrelation tofood andfeed safety. It also provides that each county government should prepare an annual food and feedsafetyreportatleast30daysbeforetheendofafinancialyear andsubmit thereport totheController.

PartIV:FoodSafetyandFeedSafetyControl andCoordination

Clause17mandates the development andperiodicreviewofamultiannual control plan. This collaborative effortinvolvestheController's office,competent authorities,andcounty governments,providingastructuredbasisforensuringthesafetyoffoodandfeedproducts withinthecountry.

Clauses18to27delveintovariousaspects of thiscoordinationframework.Clauses18 and19emphasizetheneedfor competentauthoritiestoenforceinternationalfoodsafety standards and addressany overlapsin theirfunctions.Clauses20and 21 outline a rigorous audit and verification process, allowing the Controller to assess the compliance and effectivenessofcompetent tauthorities'food safetymechanisms,including recommendationsforcorrectiveactions.

Clauses22and23focusonrisk assessment and traceabilityenforcement,whileClause24 designatesareferencelaboratoryfor confirmatory testing.Clause 25mandatesregular reporting by competent authorities and the preparation of a national food safety report. Clause 26 and 27mandates the Controller to appoint compliance officersfrom the office's technical staff,granting themtheauthorityto assess and inspectvariouspremises,vehicles, and documentsrelatedtofood safety and take samplesfor analysis.Theymustidentify themselveswhenexercisingthesepowers.

PartV:FinancialProvisions

Clauses28of theBill providesforfundsoftheoffice of the Controllerwhich consistof monies appropriated by Parliament,any grants,gifts, donations or other endowments and such otherfunds asmay accrue to the Officein theperformanceofits actions.

Clause29outlines the Controller's authority toinvestfunds or deposit surplusmoneywith the approval of the national treasury. Clause 30 focuses on financial planning,requiring the Controller to prepare annual estimates for revenue and expenditure,including provisions for salaries,allowances,property maintenance,and creating funds for future liabilities.These estimatesare submitted to the cabinet secretary for parliamentary approval.Clause31 stipulates that the annual accountsoftheController'sofficeshouldbe prepared,audited, and reported in compliance with constitutional and legal provisions, ensuringtransparency and accountabilityinfinancialmatterswithin the organization.

PartVI:MiscellaneousProvisions

Clause32oftheBillprovidesthattheActsupersedesotherActssuch thatwhere thereis aconflictbetweentheprovisionsofthisactandanyotherwrittenlawwithregardstothe powers andfunctionsoftheController then theActprevails.

Clause33oftheBill providesforpowersoftheCabinetSecretaryinconsultationwith the Controllertomakeregulationstogiveeffect to theAct.

Clause34providesforconsequential amendmentsare specifiedin theSecondSchedule.

Consequencesof theBill

TheFood andFeedSafetyControl CoordinationBill,2023,aimstostrengthenfood and feed safety control in Kenya by improving coordination,oversight,and financial managementinfoodandfeedsafetycontrol,ultimatelybenefiting thehealth andwellbeing of consumers.It will further ensure safe production, distribution,processing, marketing,andpreparationoffoodandfeedforbothpeopleand animals.

CHAPTERTWO

2.1.OVERVIEWOFPUBLICPARTICIPATIONONTHEBILL

2.1.1.Introduction

The Committeepursuant to theprovisions of Article118of the Constitution and Standing Order145(5)oftheSenateStandingOrders,proceededtoundertakepublicparticipation on theBill.In thisregard,theCommitteepublished an advertisementintheDailyNation andStandardnewspapersonFriday,22ndSeptember2023invitingmembersofthepublic tosubmit writtenmemoranda on the Bill.The advertisement was also posted on the Parliamentwebsite andsocial mediaplatforms.A copy ofthe advertisement isattached as Appendix3.

Additionally,theCommitteesentinvitationstokey stakeholdersinvitingthem tosubmit theircommentsontheBill.

Inresponse tothe advertisementandinvitations,theCommitteereceivedwritten submissions fromfive(5) stakeholders namely:The Council County of Governors(COG), Ministry ofAgriculture and LivestockDevelopment(MOALD),KenyaPlant and Health Inspectorate Service (KEPHIS),Kenya Veterinary Board (KVB) and the Kenya AssociationofManufacturers(KAM),whilethedetailedsubmissionsby thestakeholder, organized clause-by-clause,issetoutin amatrix attached as Appendix4.

2.1.2. Submissions from the Council County of Governors (COG)

TheCouncil of Governorsproposed thefollowing:

That,Clause16onthesubmissionofthereportshouldbeamendedtoputadditional requirementforthereport tobesubmitted tothe Governorand theCounty assembly.This is toprovide clarity in the handlingof the state of food andfeed safetyreport at the County level.

TheCommitteepartiallyacceptedthisproposalonreportstobesubmittedtotheCounty Assembly.TheyfurtherobservedthattheofficeofGovernorisobligatedtopreparethe reportandthereforeit'snotlogicaltoresubmitthereporttoitself

That,Clause20ontheauditof food andfeed safetymechanismbeamendedtoobligate the ControllertopresentthereporttotheresponsibleCabinetSecretaryand Governors. Thisis toprovideforthesharingofthe auditreport to therespectiveCountyGovernorsfor effectiveimplementation at the county level.

TheCommitteenotedthattheproposalwasalreadycoveredintheBill.

That,Clause33onregulationsbe amended toprovidefor Consultation with COGwhen developing regulations. To provide for an intergovernmental consultation.

TheCommitteeacceptedtheproposaltoprovideforconsultationwiththeCouncilof Governorswhendevelopingregulations,healthisasharedfunctionandthereforethe regulationwillprovideformattersthatcutacrossbothlevelsofthegovernment.

TheCommitteerejectedthisproposalbecausetheroleofcompetentauthoritiesissetout indifferentlegislationsthatestablishtheauthorities.TheroleoftheControlleristoensure thatcompetentauthoritiesadheretotheinternationalstandards.

That,Clause19ontheoverlapoffunctionsofa competentauthoritybe amendedtoobligate the Controller toconsult with the competent authoritiesandcounty government in instanceswhere an overlap occursin performanceof theirfunctionsunder theirrespective legislations.This is because food safety may cut across the county governments and the competent authorities. Therefore, there could be conflict between the county governments and the CompetentAuthoritieswhich isnotcoveredby theBill.

TheCommitteeacceptedthisproposal toprovideforconsultationwiththeCounty Governments.

That, Clause 22 on the risk analysis contravenes Clause 9 of this Bill and creates overlaps with competent authorities.Proposefor the entire Clause 22 tobe deleted.Thisis because riskassessmentisatechnical functiondomiciledin differentlegislation ofcompetent authorities carrying outfoodand feedsafety official controls.Also,it is not afunction of Food Controller as spelledout in article 9 of thisbill.

TheCommitteeacceptedthisproposaltorewordtheclausesothatthefunctionofthe controllerwillbetoreviewthefoodassessmentmeasuresthatareundertakenbycompetent authorities.

That,Schedule 2 on the Consequentialamendments onKEPHIS ACT NO 54/12.Be amended toinsert(mb) immediately after paragraph (c)ofKEPHIS Act,which is on support administration and enforcement of foodsafetymeasures.This is tobecause the amendmentproposedatMofKEPHISACT toinsert(mb)isnotinlinewithKEPHIS functions (m) which is on registration and licensing of seed merchants, growers and any otherpersonwhorequiresregistration.

TheCommitteerejectedthisproposalbecausethesubclausesareproperlyinsertedinthe Act.

2.1.4.Submissions from theKenyaAssociation of Manufactures(KAM)

TheCommitteerejectedthisproposalsincethewordiswelldefinedintheBill tomeanthe personappointedunderclause7.ThepurposeoftheBillistoformabodywhichwill be taskedwithcoordinatingcompetentauthorities.

That,ii)theInterpretationofthetermCabinetSecretarybedeleted.Thisisbecausetherole of theFood and FeedSafety Controllerwill workefficientlyifitisindependentoffering a guidingrolein theperformance ofofficial controlsby competent authorities.It istherefore importantthattheofficeisdomiciledaboveministriessothattheroleisnotlefttoone ministry.Theobjectivesin thisproposedBill depict that thefunctions ofthecontrollerwill cut acrossvariousministriesnamely,Agriculture,Trade and Industrialization,Health,and water.Foodsafetyis an essential part offoodsecurity.Thisimpliesthat health,foodsafety, andfoodsecurityarerelevanttoawiderangeofSDGswhosemonitoringand implementationisdomiciledwithintheOfficeofthePresident.Similarly,wedeemitfit thattheofficeoftheControllershouldbedomiciledundertheofficeofthePresidentto enableittoexecuteitsmandateeffectively.

TheCommitteerejectedthisproposalbecausetheresponsibilityoftheCabinetSecretary ismakingregulationsandotherrelatedresponsibilitiesbutnottosupervisethecontroller

That,Clause9onthefunctionsof thefoodandfeedsafetycontrollerbeamendedby addingafunctiononreviewofmandatesofcompetentregulatoryauthoritiestoharmonize functions and toprovide a report to the Cabinet Secretary.This is because one of thekey issuesfromtheprivatesectorthatinformedthedevelopmentoftheBillwastoharmonize functions on foodsafetyin thecountry.Forinstance,the competent authoritieslisted under thefirst schedule still have overlappingmandates andwepropose that the controller's functionbetoconductregularreviewsofthesame.Thiswillsupporttheimprovementof thebusinessregulatoryenvironmentinthecountry.

TheCommitteerejectedtheproposalbecausetheBillunderClause9providesthatthe controllershallcoordinatecompetentauthoritiesthroughimplementationofmulticontrol plan.Underclause19 thecontrollerwillgiveadvicewhereanoverlapoccurs.

That,Clause16onthefoodandfeedsafetybyCountyGovernmentswhichprovidesfor Clause161(b)forLicenseandexciseofficialcontrolofpersonswhoconductthisrole and thelicenceandexciseofficial controlbedeleted.Thisisbecauseitwill create anotherlayer of licensingwhichwould be duplication and an added burden on thecost of doingbusiness. A single entityisbetter placed toissue licences.

TheCommitteerejectedthisproposalastheroleiscurrentlybeingundertakenby the CountyGovernments.

That,Clause19 ontheoverlapoffunctionsofacompetent authoritybeamendedtoprovide moreclarityon the extentoftheduplication andprocess toresolve the same.This is because the competent authorities are already set independent bodies.The procedure or guidelinesonresolving overlaps or conflicts in themandate tobe anchoredin thelawto supportimplementation.

TheCommitteerejectedthisproposaltheyobservedthatthesamebelefttoregulations

That,Clause21 on theVerification audit be amendedbyintroducing anewparagraph 21 (2)toprovideforregulations toprovideclarification on the compensationmechanism.This is because theprovision of Clause 21 (l) doesnotprovide clarity on the extentof the compensationmechanismandthereis aneedformoreclarificationonthetypeand amount ofcompensation,thepayer,and therecipient of thecompensation.

TheCommitteerejectedthisproposalsincethepurposeoftheclauseistoconductaudit oncompetentauthoritiestoascertaintheirefficiencyandeffectiveness.

That,Clause23onthetraceabilitybeamendedtointroduceanewsub-clausetoprovide for the specific traceabilityrequirements thatfood andfeedbusiness operatorswill need to adhereto.Food andFeedbusinessoperatorswill beinabetterpositiontocomplywiththe traceabilityrequirementsif theyare awareofthembeforehand.To anchorthemin thelaw andprotectfood andfeedbusinessoperatorsfromrequirementsthatmaybeimposedupon themwithouttheirinput.

TheCommitteerejectedtheproposalsincetheintentionoftheBillistoensurecompliance bycompetentauthoritieswiththerequirementssetbytheenablinglegislationsandnotto setnewrequirements.TheserequirementsalreadyexistindifferentActsandRegulations.

That,Clause24on thereference to alaboratorybe amended tointroduce a newsub-clause toincludeamechanismtomonitornecessarypublicstructures testingtofacilitate from competent authoritiesontheprogressofsettinguppublicinfrastructuretosupport accredited testing tofacilitate the easeof doingbusiness.Businesses continued to be impactedby theabsenceof adequatetestingfacilitiesinthecountrytofacilitatetheir productionprocesses.Thishasled to delays and affected the ease of doingbusiness.To offer information on the criteria for designating official testing laboratories is in line with theaccredited testingrequirementbyrelevant authorities.

TheCommitteerejectedtheproposalbecauseitprovidesondesignatingofindependent laboratoriestoconducttestincaseofanadverseauditreport.

That,Clause 27on thepowersof the compliance officer be amendedby deleting it.The roleoftheOfficeoftheControllerisoverarching.Itprovidesfortheeffectivecoordination ofcompetentauthoritiesinthecontrol offood andfeedsafetyand thereforeshouldnotbe excitingoperationalrolessuch asinspection,and enforcement.

TheCommitteerejected thisproposal,itobservedthat,theofficeofthecontrolleris requiredtoperforminspectiononcompetentauthoritytoensurecompliance.

That,Clause33 on regulationsbe amended toreplace the word'regulations'with 'guidelinestoavoidduplication ofdevelopmentofregulationsbyrelevant authorities. This isbecause all the competent authorities regulating food safetyhave their own regulationsandrequiring additionalregulationswill increase theregulatoryburdenfor businessesin thecountry.

Thecommitteerejectedthisproposal.

That,Clause33onregulationsbeamendedtodeleteClause33toavoidduplicationof already existingnationalregulations on the conduct ofrisk analysis,traceability,and designation of laboratories.All thecompetent authoritiesregulatingfoodsafetyhavetheir ownregulations,some ofwhich touchon theproposed areas underclause33.

2.1.5.GeneralComments

2.1.5.1.Ministry ofAgriculture andLivestockDevelopment

AscapturedinthepresentBill,regulationofFoodsafetyshould alwaysbedoneseparately fromregulationofmedicinesasguidedbytheSPSAgreementofWTOandother internationalstandardsettingbodies.

TheBill isproperlydraftedtoaddressthecurrentchallengesinfoodsafetyregulation devoid of anybusinessinterestsandisbackedby a soundFoodSafetyPolicy.

While thechoiceofwhichministry takestheleadinfoodcontrolandfoodsafetyis determinedbylocal politics,theFAOhasputastrongcasefortheministryresponsiblefor agriculture asit is able to addressfoodsafetyissues along the entirefoodproduction chain fromfarm tofork.Manyhazards enterthefood chainduringtheproductionprocess,which should be controlled through the application of good agricultural practices,good manufacturingpractices andgoodhygienepractices. Generally,theministryresponsible for agriculturehas thenecessaryskills andknowledge tobuild therequired safety and exports are often a criticalpart of many countries'(especially developing countries) foreign exchange earnings,there are strongjustificationsforthe agricultural sectormaking significant investmentsto ensure that foodproductsmeetestablished standards. Involvementof theministryresponsiblefor agriculture is also abetterway to secure farmerscapital investments,in that preventive measures are applied,andunsafe products canberemovedearlieralongthefoodchain.

TheCommitteeagreedwiththeviewsoftheMinistryandnotedthattheBillasdrafted definesaCabinetSecretaryasthecabinetSecretaryinchargeofFoodSafetywhichisa departmentintheMinistryofAgriculture.

2.1.5.2.TheKenyaVeterinaryBoard(KVB)

As captured in thepresentBill,regulation ofFoodsafety should alwaysbedone separately fromregulationofmedicinesasguidedbytheSPSAgreementofWTOandother ReportontheFoodandFeedSafetyControlCoordinationBill,2023 12

international standard settingbodies.TheBill isproperly drafted to address the current challenges in food safetyregulation devoid of anybusiness interests and isbacked by a soundFoodSafetyPolicy.

CHAPTERTHREE

3.1.COMMITTEEOBSERVATIONSANDRECOMMENDATIONS

3.1.1.COMMITTEEOBSERVATIONS

TheCommitteeobservedthat:

  • 1.Theroleof theFood andFeedSafetyControllerwill workefficiently if it is independentoffering aguidingrolein theperformance ofofficial controlsby competentauthorities.Itistherefore,important that theofficeisdomiciled above ministriesso thattheroleisnotlefttooneministry;
  • 2.Food safety cuts across the County Governments and the competent authorities. Consequently,theBill shouldfactor in therole of the countygovernmentsin food andfeedsafety.TheCommitteenoted thatthereisgapinclause 4of the Billwhichprovides that theActwill applyto competent authoritiesas listed under the first schedule,the schedulehowever does not include the county governments.Noting that County health services are devolved,the implementationofthisActshould thereforebeundertakenbybothlevelsof government;
  • 3.The submission of the annual reports is important both at theNational and at the Countylevel.The annual reportshould thereforebe submitted by the Governor toboth the County assembly and to theCabinetSecretaryso as toprovideclarity in thehandlingofthestateoffood andfeedsafetyatbothlevelsofgovernment; and
  • 4.That amechanismshould beputinplace tofacilitateconsultationsbetween the Controller and a competent authority or a county government in instanceswhere an overlapoccurs.

3.1.2.COMMITTEERECOMMENDATIONS

The Committee recommends that theHouse approvesthereport togetherwith the followingamendments:-

  • 1.That,clause 4of theBill be amended toprovidefor theapplication of theBill to both the competent authorities and the county governments;
  • 2.That,clause19 oftheBill be amended toprovideforconsultation in cases where an overlap occursbetween the Controller andcompetent authorities orthecounty governments;
  • 3.That,clause 22oftheBillbe amended toprovide thatwhere a riskis identified, the controllershall advise therelevant authority on stepstobe undertaken to managetherisk;and
  • 4.That,clause33oftheBill onregulationsbe amended toprovideforConsultation with the Council of County Governorswhen developingregulations.

The essence of the Bill was to amend the Narcotics Drugs and Psychotropic (Control) Act to exempt cathine and cathinone substances which arenaturally found inMiraa Cropfrom beingclassified as apsychotropic substance.

This would remove the bottlenecks around the marketing of value-added productssuch asMiraaJuice andWine apart from the cropitself.

The Committeewas informcd that thercwould bcneed for international lobbyingshould thelawpass toallow the export andmarketingofMiraa-and its products.

The Committee resolved to invite the Sponsor of the Bill to inform the Committeewhethcr therehadbeencommunication/liaisonwiththeNational Campaign Against Drug Abuse (NACADA) towards the declassification of Miraa Crop.

Thestakeholderspresented tothecommittee asfollows-

  • The Kenya VeterinaryBoard:The acting ChiefExecutive Officer stated that they supported theBill and hence had no amendments.

The senators asked the acting ChiefExecutive Officer some questionsregarding the securityof thepopulation when it comes to contaminatedmeatandmilk especiallythroughvaccinationsandhowGMOscanbefactoredintotheBill.

TheactingChiefExecutive Officerinformed theCommittee that theBoard usuallyregulatesthepersonsdealingwithanimals andthattheyhaveeducated the publicthatall meat shouldbeslaughteredin theslaughterhouse.She also added that there are existing lawswhereby all meat slaughtered and inspected is required tohave the roller stampfrom the VeterinaryOfficer stationed at the slaughterhouse.Once the meat is inspected and sold,a permit is issued.

She alsoinformed theCommittee thatwhenitcomestomilk,ananimalthathas beenvaccinatedgoes through a period ofwithdrawalof at least thirty (30) days beforemilking it.

On GMOs,sheinformed theCommittee thatit'sarequirementforanyGMO producttohave alabel that says theproductis GMO.This is done to give the consumers a choice of either buying the product or not.KEBS havea responsibilityofindicatingGMOfood/productsfor thepublictodecidewhether toconsuimeornot.

2. TheKenyaAssociation of Manufacturerspresented thefollowingamendments: 2. Clause 2Change the interpretation of the 'Controller'and Cabinet Secretary'; 3. .Clause9Introducenewprovisions under functions of the controller after Clause 9 (h); 4. Clause 16-

Delete the entire Clause;

  • Clause 19Amendittoprovidemoreclarityontheextentofduplication and processestoresolvethesame;
  • Clause21Introduce new paragraph (2) to provide clarificationon compensationmechanisms;
  • Clause 23Introducenewsub-clause23(2)toinclude specifictraceability requirements for food and feed business operators need to adhere to; and
  • Clause24Introduce new sub-clause(2) to includemechanisms to monitor public structures testing.

TheKenyaAssociationofManufacturersfurtherspokeofthedisconnectbetween regulators andfarmers/business community should bebridgedbyan advisoryrole to assistinimproving thebusiness environment.The costofcompliance should be reduced.

PART1-PRELIMINARY

  • 1.ThisActmaybe cited as theFood and FeedSafety Control Co-ordinationAct,2023.
  • 2.In this Act, unless the context otherwise requires-

"Cabinet Secretary""means the Cabinet Secretary responsibleforfood safety;

"competent authority"means the public institutions responsibleforofficialcontrolsetoutintheFirstSchedule, orsuchotherpublicentityastheCabinetSecretarymay,by Orderin the Gazette,determine;

"compliance officer"means a person appointed as such undersection26;

"consumer"means-

  • (a)aperson towhomparticulargoods orservices aremarketed in the ordinary course of the supplier's business;
  • (b)aperson whohas entered into a transaction withasupplierin theordinarycourseofthe supplier's business,unless the transaction is exemptfromtheapplicationofthisAct;
  • (c)auserofaparticulargoodorarecipientor beneficiary ofparticular services,irrespective ofwhether that user,recipient or beneficiary wasaparty toatransactionconcerning the supplyof those particular goods and services; and

Shorttitle.

Interpretation.

  • (d)afranchisein terms ofa franchise agreement, to theextent applicablein termsof thisAct.

"Controller"means a Food and Feed Safety Controller appointedundersection7;

"feed"means processed, semi-processed or raw materialwhichis tobeconsumeddirectlybyananimal whichisconsumedasfoodorananimalwhoseproduceis capableofbeingconsumedasfood;

"feed business"means the production,manufacture, storage or distribution of feed,feed ingredient, feed additiveorfeedsupplement;

"feed ingredient"means a component or any combination.ofcomponentsused in theproduction offeed andincludesafeed additive;

"feed safety"means all measures that ensure that feed willnotcause harm toananimal which is consumed as foodor to an animalwhoseproduceis capable ofbeing consumedas food,whenthe feedis consumedin accordancetotherecommendeduseofthemanufacturerof thefeed;

"food"means a processed,semi-processed or raw substance which is consumed bya humanbeing and includesdrinkingwateranda substancewhichhasbeen used in the production,manufacture,preparation or treatmentoffoodbutdoesnotincludeacosmetic,tobacco or a substance used as drugs;

"food business"means the production,processing storageordistributionoffoodforcommercialpurposesbut does not include the domestic preparation,handling or storage offoodforconsumptionwithin aresidence;

"food safety"means measures taken to ensure that foodshallnotcauseharm toaconsumerwhen consumed according to its intended use;

"hazard"means any biological, chemical or physical agentorconditionoffoodor feedwhichiscapableof causingan adversehealtheffect;

"multi-annual control plan"means a plan which-

  • (a) specifies information on the structure,roles and

responsibilities of the CompetentAuthorities;and

  • (b)providesanoverviewofhowthecompetent authoritiessafeguardthehealthofthemembersof the public,animal and plant health and protects consumers;

"official control"means a regulatory activity bya CompetentAuthority that-

  • (a)provides protection to a consumer during the production,handling,storage,processing and distributionoffoodorfeed;and
  • (b)ensuresfoodorfeed issafe,wholesome andfitfor human consumption,andconforms to the quality andsafetyrequirementsfortheconductoffood business or feed business;

"Office ofthe Controller"means the Office of the FoodandFeedSafetyControllerestablishedundersection 6;

"risk analysis"means a process which consists of risk assessment,riskmanagementandriskcommunication;

"risk assessment"means a scientifically based process whichconsistsofthe-

  • (a)identification ofahazard;
  • (b)characterisation ofahazard;
  • (c)assessment of the exposure to the hazard;and
  • (d)characterisation of therisk;

"risk communication"means the interactive exchange ofinformation andopinions throughoutarisk analysis on the risk-related factors,risk perceptions ofrisk assessors, risk managers,consumers,industry,the academic community andotherinterestedparties,and theexplanation ofriskassessment findingsasthebasisof risk management;and

"risk management"means the process ofevaluating policy alternatives,in consultation with interested parties consideringrisk assessmentandother factorsrelevantfor theprotectionofhealthofconsumersandforthepromotion offair-raderactces,and,fded,slctingappropriat prevention and control options.

  • 3.The object of this Act is to—
  • (a)effectivelycoordinatetheperformanceof the functionsof competent authorities;and
  • (b)enhance accountability in the implementation of official control.
  • 4.ThisAct shall apply to every competent authority.
  • 5.The guidingprinciples for the implementation of thisActshall be-
  • (a) the protection of human health;
  • (b)theprotectionofconsumerinterestsintheconduct offoodbusiness andfeedbusiness;
  • (c)thepromotionof theuseofscientificbasedrisk analysis;
  • (d)thepromotionoffoodsafety andfeedsafety;
  • (e)thepromotionoffair-tradepracticesin theconduct of food business and feed business;
  • (f)efficiencyin theperformance ofofficial control;
  • (g)thepromotionof sustainableproduction, processingandhandlingoffoodand feed;and
  • (h) the protection of animal health.

PARTII-OFFICEOFTHEFOODANDFEED SAFETYCONTROLLER

Establishmentof theOfficeof the Food andFeed SafetyController.

  • 6.(1)There isestablished theofficeof theFood and FeedSafety Controller which shall bea body corporate with perpetual succession and a common seal,andin its corporatename shall becapable of
  • (a) suing and being sued;
  • (b)acquiringordisposingofmovable and immovable property;and
  • (c)performing such acts asmaybeperformed bya body corporate.
  • (2)TheOfficeoftheControllershallbedesignated as a State Office in accordance with paragraph (q) in the definitionofStateOfficeunderArticle260ofthe

Object of this Act.

Applicationof thisAct. Guiding principles.

Constitution.

7.(l) There shall be a Food and Feed Safety Controllerwhoshall be appointedby thePresident,with theapprovalofParliament.

(2)Wheneveravacancyarisesin theofficeof the Controller,thePublicServiceCommissionshall initiate the recruitment process.

(3)Within seven days of thevacancyreferred toin sub section(2)occurring,the Public Service Commission shall invite applications from persons who qualify for nomination and appointmentforthepositionofthe Controller.

(4)The Public Service Commission shall within twenty-one daysofreceiptofapplications undersubsection (3)—

  • (a)consider the applications received to determine their compliancewith thisAct;
  • (b)shortlist qualified applicants;
  • (c)publish and publicise thenamesof theapplicants and the shortlisted applicants;
  • (d)conduct interviews of the shortlisted persons
  • (e)nominate three qualified applicantsin the orderof meritforthepositionofController;and
  • (f)submit thenamesof thepersonsnominated under paragraph (e) to thePresident.

8.(1)Aperson shall qualify tobe appointed as the Controllerif thatperson—

  • (a)holdsaMastersdegreeina disciplinerelated to foodsafety orfeedsafety;
  • fieldrelated tofoodsafetyorfeedsafety;
  • (c)has atleast five years'experience workingina seniormanagementposition;and
  • (d)meets the requirements of Chapter Six of the Constitution.
  • (2)The Controller may be appointed for a term of

  • 9.Thefunctionsof theControllershallbeto
  • (a)coordinate the competent authorities through the implementation of themulti-annual control plan;
  • (b)coordinatethedevelopmentandreviewofamultiannual national control plan;
  • (c)monitor and evaluate the implementation ofa multi-annual control plan at thenational level;
  • (d)liaisewithcompetentauthoritiestoidentifyand adviseonpolicygapsandinadequateregulationon foodsafetyandfeedsafetyofficialcontrol;
  • (e)assesstheadequacyoffoodsafetyandfeedsafety preparedness and make recommendations to the relevant competent authority;
  • (f)establish aninformation management system for foodsafetyandfeedsafetyin thecountry;
  • (g)verify thatcompetent authoritieshaveputin place systemsforeffectiveofficial control;
  • (h)prepare anannualreport on the stateoffood and feed safetyinKenya;and
  • (i)perform such other duties asmaybenecessaryto ensure coordination ofofficialcontrolof food safetyandfeedsafety.

10.TheOfficeoftheControllershallbecomevacant, if the Controller-

  • (a) dies;
  • (b)resigns from officeby noticeinwriting addressed to thePresident;or
  • (c)is removed from officeinaccordancewith section 11.
  • 11.(1)TheControllermayberemovedfromofficeon thefollowinggrounds-
  • (a)violation of ChapterSix of theConstitution;
  • (b)gross misconduct in the performance of the functions of the Controller;
  • (c)incapacityto perform the functions of the

Controllerduetophysicalormentalillness;

  • (d)beingadjudgedbankrupt;or
  • (e)beingconvictedofanoffenceandsentencedtoa termofimprisonmentexceedingsixmonths.

(2)Apersonwhodesires theremovalof theController a complaintto thePublicService Commission settingout the allegedfacts constitutingthatground.

(3)Subject to Article 47of the Constitution,the Public Service Commission shall consider the complaint and,if satisfied thatthecomplaintdisclosesaground under subsection(1),thePublicServiceCommissionshall

  • (a)investigate thematterexpeditiously;
  • (b)report on thefacts;and
  • (c)make arecommendation to thePresident.

(4)Prior to any action under sub-section (3),the PublicServiceCommissionshall-

  • (a)inform theController,inwriting,ofthereasonsfor theintendedremoval;and
  • (b)offer the Controller an opportunity to putina defence against the allegedgrounds.

12.The Controller,in consultation with the Public Service Commission,shall employsuchmembersofstaff asarenecessaryforthedischargeofthefunctionsofthe Controller on such termsofserviceas the Controller in consultationwiththeSalariesandRemuneration Commissionmay determine.

13.TheControllershallbepaidsuchremunerationor allowancesas theSalariesandRemuneration Commission maydetermine.

Remuneration of the Controller.

14.TheControllermaydelegate theperformanceof anyofthefunctionsoftheControllertoanymemberof staffoftheOfficeoftheControllerastheControllerdeems necessary.

Delegation by the Controller.

15.(1) The Controller or a member of staff of the Protecion from personal liability. Office of the Controller,or a person acting on the directionsofthe Controller,shallnotbepersonallyliable foranyaction,claimordemandwhatsoeveroranymatter orthingdoneintheperformanceof thefunctionsofthe OfficeoftheControlleringoodfaith.

(2)Subsection(l)shallnotrelieve theOfficeofthe Controllerof theliabilitytopaycompensationordamages, for loss or injury to a person or property,in the performance of the functions on the Officeof the Controller.

PARTIII-FOODSAFETYANDFEEDSAFETYBY COUNTYGOVERNMENTS

16.(1) The functions of a county government in relationtofoodsafetyandfeedsafetyin therespective County shall be to

  • (a)implementandenforcefoodsafety andfeedsafety measures;
  • (b)license and exercise official control of persons who conductfoodbusinessandfeedbusiness;
  • (c)conduct capacitybuildingon foodsafety andfeed safety;
  • (d) conductpublic awareness on matters food safety and feed safety;
  • (f)provide aplatform for the consultation and cooperation of the County Governments and stakeholdersintheimplementation ofamultiannual control plan;
  • (g)conduct audits to ascertain compliance and enforcementof food safety andfeed safety measures;
  • (h) coordinatefood safety andfeed safety activities;
  • (i)regulate and enforce official control;and
  • (j)monitor and evaluate implementation of the multiannual control plan.

(2)Each County Government shall atleast thirtydays before the end of afinancial year,prepare an annualreport onthestateoffoodsafetyandfeedsafetyintherespective County andsubmit thereportto theController.

PARTIV-FOODSAFETYANDFEEDSAFETY CONTROLANDCOORDINATION

17.TheOfficeof theController,in consultationwith Functions ofa county govermment.

  • 18.(1) The Controller shallverify thata competent authorityhasmechanisms to enforce therequirementsof foodsafetyorfeedsafetyin accordancewithinternational standardsoffood andfeedsafety.
  • (2)The scope ofverificationconductedbythe Controller shall include-
  • (a)conduct ofinspections;
  • (b) taking of samples and conducting analyses;
  • (c)staff health and hygiene;
  • (d)examination of therecords;and
  • (e)issuance of certificates,permits and licenses.
  • (3)Upon conductingaverificationunder sub-section (1),the Controller shall prepare a report and submit the report to the Cabinet Secretary responsible for the competent authority.
  • 19.The Controllerin consultationwith the competent authorities shalladvise where anoverlap occursin the performance of their functions under their respective legislation.
  • 20.(1)The Controller shall conduct an auditof the foodsafetyorfeedsafetymechanismsofacompetent authorityto ascertain compliance and enforcement.
  • (2)The Controller in liaison with the competent authorities,shall develop the criteria for conducting the audit under subsection(1).
  • (3) Upon conducting an audit under subsection (1), the Controller shall prepare an audit report and submit the report totheCabinet Secretaryresponsible for the competentauthorityandeachCountyGovernment.
  • 21.(1) The Controller shall conduct a verification audit toascertain whether the systemsestablishedbya competent authorityprovideaccurate certification, inspection andvalidationof
  • (a)the effectivemonitoring of compliancewith set standards;
  • (b) the implementation of corrective measures

  • (i) theeffectivenessoftheearlywarning systemfor foodsafety risks,where applicable;
  • (i) theeffectivenessof theearlywarning systemfor feed safety risks;
  • (k) the effectiveness ofthe handlingandresolution ofcomplaints;
  • (I the compensation mechanism;and
  • (m) such other matter as the Controller considers necessary.
  • (2)On conducting a verification audit,if it is determined that the competent authorityisin contravention ofsubsection (1),the Controller shall recommend correctivemeasureswhichare tobeundertakenwithinthe specified timelines.
  • (3)Whereacompetentauthority doesnotimplement the corrective measures recommended under subsection (2),the Controller shall notify the Cabinet Secretary responsibleforthecompetent authorityof the contravention.
  • 22.(1) The Controller shall conduct risk assessment in Risk analysis. relationtofoodhazardsandfeedhazards.
  • (2)Whereanoverlapoffunctionsisdiscoveredupon conducting a risk assessment under subsection (1),the Controller may conductriskmanagementon an identified hazard.
  • (3)Upon conducting risk kmanagementunder subsection (2),the Controller,shall communicate therisk ofthehazardtotherelevantcompetentauthority.
  • (4)The Controller,in consultation with competent authoritiesshalldevelopandmaintainfoodsafetyandfeed safetyriskprofilesforeveryregionof thecountry.
  • 23.TheControllershallverifythatacompetent authorityhasaneffectivemechanismtoenforcetraceability requirementsbypersonsconductingfoodbusinessorfeed business.
  • 24.(1)TheControllerinconsultationwith therelevant competentauthorities shalldesignatealaboratory asa referencelaboratoryforconfirmatorytesting.
  • (2)Uponreceipt of anadverse report,the results of an audit conducted under this Actor a complaint bya consumer,theControllershall conductconfirmatorytesting atadesignatedlaboratoryforfoodandfeedsafetycontrol.
  • 25.(1)Every Competent Authority shall,at least thirty days before the end ofa financial year,prepare and submit areporton themeasurestaken to ensurefoodsafetyorfeed safetyto——
  • (a)the relevant competent authorities;and
  • (b)theOfficeoftheController.
  • (2)On receiptofthereportsunder subsection(1),the Controller shall--
  • (a)analysethereportsandprovidefeedback tothe competent authorities;and
  • (b)within threemonths after the endofa financial year,prepareanannual reporton thestateoffood safety andfeedsafetyintheCountry.
  • (3)The Controller shall submit the report prepared under subsection(2)(b)to
  • (a)the Cabinet Secretary;
  • (b)all theCountyGovernors;and
  • (c)the competentauthorities.
  • (4)Onreceiptof thereportsunder subsection(3)(a), the Cabinet Secretary shall submit the reportsto Parliament.
  • 26.The Controller shall appoint such compliance officers asarenecessaryfor theproperdischargeof the

  • 27.(1) A compliance officer may at all reasonable times

PARTV-FINANCIALPROVISIONS

  • 28.The fundsoftheOfficeof theController shall consistof-
  • (a)moneys appropriatedbyParliament;
  • (b)any grants,gifts,donations or other endowments given to the Office of the Controller;and
  • (c)such funds as mayvest in or accrue to the Office ofthe Controller in the performanceof its functions under thisAct or anyotherwrittenlaw.
  • 29.The Controllermay invest the fundsof theOffice oftheController-
  • (a)in trust funds or in any other securities;or
  • fortheperformanceofthefunctionsof the Controller,

with the approvalof theNationalTreasury.

  • 30.(1)Atleastthreemonthsbeforethe commencementofeachfinancialyear,theControllershall preparetheestimatesoftherevenueandexpenditureofthe OfficeoftheControllerforthatfinancialyear.

(2)The annual estimates shall provide for all estimatedexpenditureoftheOfficeoftheControllerforthe financial year concerned,and in particular shall provide for-

  • (a)the payment of the salaries,allowances,pensions, gratuities,retirement benefits and other expenses

  • 31.TheannualaccountsoftheOfficeofthe Controller shall be prepared,audited and reported in accordancewiththeprovisionsofArticle226ofthe Constitution,the Public Finance Management Act,2012 and thePublicAuditAct,2015.

PARTVI-MISCELLANEOUSPROVISIONS

32.Where there is conflictbetween theprovisionsof thisActandtheprovisionsofanywrittenlawwithregard tothepowersorfunctionsoftheController underthisAct, theprovisionsofthisActshallprevail.

  • 33.(1) The CabinetSecretary in consultationwith the Controller,may make regulations for the better carrying intoeffectofthisAct.
  • (2)Without prejudice to subsection (1),the regulationsmadeunderthissectionmayprovidefor
  • (a)the conductof risk analysis;
  • (b)thetraceabilityoffood andfeed;
  • (c)thirdparty authorization;
  • (d)thedesignationoflaboratoriesforofficialcontrol; and
  • (e)anyothermatternecessaryforbetterrealisationof theobjectof thisAct.

1.0ISSUE

TheExecutiveforwardedtheFoodandFeedSafetyControlCoordinationBill toParliament toprocessafter going throughextensivestakeholder engagementlocallyandinternationally.TheBillseekstoprovideforthe coordinationofthepublicinstitutionsin thecontrol offood andfeedsafety fromfarmtofork;toestablish theofficeoftheFoodSafetyController;to providefortheroleoftheCountyGovernmentsinfoodandfeedsafetyand forconnectedpurposes.

2.0BACKGROUND

  • 2.1Foodsafetymeans all measuresputinplacetoensure thatfoodwill not causeharmtotheconsumerwhenitispreparedand/oreatenaccordingto itsintendeduse.Itiscentral toconsumersafety,publichealth,foodsecurity andkeytofacilitationoflocalandinternational trade.Accesstosafefood the Constitution ofKenya.Food safetyneeds tobe assuredbyprotecting thefood supplyfrom all types ofhazards thatmay occur during all stagesof food production, including growing, harvesting, processing, transporting, retailing,distributing,preparing,storing and consumption.

  • 2.3EnsuringthatFoodissafeisacollectiveresponsibilityandinKenyathe FoodSafetycontrolismanagedusingseverallawsimplementedbythree key Ministries:Ministry of Agriculture,Livestock.Fisheries and Corporative, MinistryofHealthandtheMinistryofTradeandIndustrialization.The existingfoodsafetypolicyandlawshavefailedtoharmonizeoperationsof thedifferentactorsandagencies.Thishashamperedeffectivecoordination offoodsafety in the country leading topersistent lapses infoodcontrol.
  • 2.4FoodSafetyregulationrunsalongthefarmtoforkcontinuumwhere various competencies are necessary to play their role in assuring food safety through all stages of production up to sale.
  • 2.5Internationalgoodpracticedoesnotmixfoodsafetyregulationwith Veterinarymedicinesareonlypartoffoodsafetyasfarasthoseusedon food animalssincetheycanbeconsumed inmilkandmeatif appropriate on the Codex Alimentarius Commission (CAC) which is a joint initiative the Organization (WHO). The International Standards supporting implementation of thefoodsafetymeasures arebased on theWorldHealth International Piant Protection Convention (IPPC) for humans, animals, and plantsrespectively.TheSecretariatfor CAC ishostedbyFAO.

3.0ROLE OFVARIOUS MINISTRIES INFOOD SAFETY

Whilethechoiceofwhichministrytakes the lead infoodcontrol andfood safety is determined by local politics, the FAO has put a strong case for the ministry responsiblefor agriculture as it is able to addressfood safety issues along the entire foodproduction chain fromfarm to fork.Many hazards enter the food chain during the production process, which should be controlled through the application of good agricultural practices, good manufacturing practices and good hygiene practices. Generally, the ministry responsible for And because agricultural exports are often a critical part of many countries (especially developing countries')foreign exchange earnings,there are strong justificationsfor the agricultural sectormaking significantinvestments toensurethatfoodproductsmeetestablishedstandards.Involvementofthe ministryresponsiblefor agriculture is also abetterway tosecurefarmers capital investments, in that preventive measures are applied, and unsafe productscanberemovedearlier alongthefoodchain.

  • 4.1 The two MinistriesofHealth,Agriculture and LivestockDevelopment developedaroadmapuponwhichtodeliveramorecomprehensiveFood SafetyPolicyandBill.Thiswastobefollowedbyaseriesofstakeholder engagements,call forpubliccommentsthroughnewspapersand abench marking trip to theUnited StatesofAmerica(USA)andDenmark.TheUSA andDanishvisitsweredesignedtospecificallyunderstandtheirsystemfor foodregulation.
  • 4.2Theprocessofdevelopingthepolicyandbillwashoweversuffereda setbackinMarch2020followingtheCOVID19pandemic.However,from early2021to2022,themultistakeholdertechnicalteamdevelopedtheDraft PolicyandBillwhichwastakenthroughstakeholderengagementincluding presentationtotheDepartmental CommitteesonAgricultureandLivestock ofbothlevelsofParliamentbeforesubsequentvalidation.

Food safety iscentral topublichealth,povertyreduction and sustainable development.Access to safefoodisafundamentalrightas prescribedinArticle43asreadwithArticle46oftheConstitution ofKenya.Overtheyearsconcertedefforts and initiativeshavebeen directedataddressingimprovementoffoodsafety.

Protectingconsumersfromcontaminatedorunsafefoodsandfeedscost a significant amount of expenditure inanyfood and feedindustry business.Thesepreventativemeasures are both timeandresourceintensive,butconstituteanessential partofdoingbusinessinthefood and feed industry.

Cognizant that food is as safe as its produced,we appreciate that contaminationmay occur atanypoint alongthefoodvalue chain. EnsuringthatFoodissafeisacollectiveresponsibilityandvarious agenciesunderdifferentministriesandusingdifferentlawsmanagethe Agriculture and Livestock Development,Ministry of Health,Ministry of Blue Economy and Mining(Fisheries) and the Ministry of Investment and Industrialization.

Rationaleofthe Food and Feed Safety Bill

Ensuringfoodandfeed safetyandproductqualityisademanding, ongoingundertaking thataffects everylevel ofthefood andfeedsupply chain.In ordertopreventrecalls and improveproductivity,food andfeed processorsandmanufacturersneed an effective food and feed safety managementsystem.

TheEULegislation178,whichstrengthenedfoodsafetyrequirements, necessitatedKenya having acoordinationmechanismfor foodsafety system.Asearly as2013theneedtoreviewexistingfoodsafetylegislative framework andcreation of abody to directandcoordinate all Government activities in the field of food safety in close collaboration with all relevant governmental and non-governmental sectors had been provided for in the Food Safety Policy of 2013.

Currently,the coordination onfood and feedsafety is bya jointcommittee of theMinistryofHealthandMinistryofAgricultureknown asNational FoodSafety Coordinating Committee.Thiscommittee lacks thelegal mandate tohandlefoodsafetymatters and is thereforevery ineffective.

TheFoodSafetyPolicy2013hassincebeenreviewedtoestablishand maintain a rational, integrated farm-to-fork food safety system that overlap,establish a coordination mechanism.This will ensure the protectionofpublicsafetyandfoodtradeconsistentwithWorldTrade Organization(WTO)agreementontheSanitaryandPhytosanitary(SPS) Protocolmeasuresandother.internationalrequirements.

ThisBill comprehensively addressfoodsafety challenges based onpolicy withatargetedscopeandprovisionswithafocusoneffective implementationbasedonthefollowingconsiderations:

Introduction

KEPHISsupportsenactmentofthisbilltoanActofParliamentofKenya.TheActwill addressseveralgapswithintheKenyanFoodControlSystemkeyamongthembeingthe coordinationofseveralcompetencyauthoritieswhohavearoleinfoodandfeedsafety.

KEPHISherebypresentssubmissionsthatwillenhanceoperationalizationoftheActas follows:

1.Article4:

Foodsafetycutacross the countygovernments and the competentauthorities.The Competent AuthoritiesandtheCountyGovernmentsareresponsiblefor the implementationofthisAct.

Therefore,weproposeamendmentofarticle4whichreadsThisactshall applytoevery competentauthorityandeverypersonconductingfoodbusinessorfeedbusiness'to read;

This act shall apply to every competent authority, County Governments and everypersonconductingfoodbusinessorfeedbusiness'

  • 2.Section16onFoodSafetyandFeedSafetybyCountyGovernmentstalksabout thefunctionofcountygovernmentswithrespecttofoodsafetyandfeedsafetyin respectivecountiesshallbeasgivein161a-].

However,theroleofcompetentauthoritiesinrelationtoInternational tradewhichcuts acrossallcountieshasnotbeendefined.

Therefore,wepropose toimprovePartIII tocovercompetentauthoritiesand County Governments.Article 16(1)tocover CompetentAuthorities and 17(1)tocover the County Governmentswherethecurrent16(1 and2)willbe renumberedas 17(1 and 2) toreadasfollows:-

  • (b)license and exercise official control of persons who conduct international food businessandfeedbusiness;
  • (c) conduct capacity building on food safety and feed safety;
  • (d) conductpublicawarenessonmattersfoodsafetyandfeedsafety;
  • (e) prepareNationalfoodsafetyandfeedsafetyreports.
  • (g) conductauditsto ascertaincompliance andenforcementoffoodsafetyandfeed safetymeasures;
  • (h) coordinatefoodsafetyandfeedsafetyactivities;
  • (i)regulateandenforceofficialcontrol;und
  • (1)monitor und evaluateimplementation ofthemulti annual control plum

3.Article19:

Foodsafetymaycutacrossthecountygovernmentsandthecompetentauthorities.For example,productionforexportcommoditieshappensinthecountieswhiletheirexport isregulatedbynational competentauthorities;Similarly,consumptionofimportedfoods happensat thecountieswhileregulationshappen atNational andcounties.

Therefore,therecouldbeconflictsbetween thecountygovernmentsand theCompetent Authoritiesthatisnotcoveredbythebill.

Wethereforeproposetoreviewarticle19whichreadsTheControllerinconsultation withthecompetentauthoritiesshalladvisewhereanoverlapoccursinperformanceof

KVBisaregulatoryAgencymandatedtoascertainprovisionofqualityveterinary servicesthrough"exercisinggeneralsupervision and controloverthetraining,business, practiceandemploymentofVeterinarySurgeonsandVeterinaryParaprofessionals inKenya and advice the government in relation to all aspects thereof".KVB establishedbytheVeterinarySurgeonsandVeterinaryParaprofessionals(VsVP)Act of2o11iscentral inregulatingthedeliveryofveterinaryservicescountrywide.The scopeofregulationofveterinarypracticeincludesveterinaryclinical&surgical practice,veterinarymedicinesregulation,animalhealthrelatedtraining,certification offoodsofanimaloriginandtherestoftheveterinarydomain.Wehavereviewed the proposed Billand are in full support as the Billseeks to provide for the coordinationofthepublicinstitutionsincontroloffoodandfeedsafetyfromfarmto fork;toestablish theofficeof theFoodSafetyController;toprovidefor theroleof the CountyGovernmentsinfood andfeed safety andforconnectedpurposes.

Considering that;

  • 1.KenyaasasignatorytotheWorldTradeOrganization(WTO)mustabideby therules-based trade under theWorld TradeOrganization(WTO)beinga signatorytoalltreatiesandagreementsoftheWTO,includingtheAgreement onApplicationofSanitaryandPhytosanitaryMeasures(SPs Agreement). UndertheSpsAgreement,Kenya hastherighttosetown lawsand regulations, providedtheyarenotinconflictwith theprovisionsoftheSPsAgreement.
  • 2.Foodsafetymeansallmeasuresputinplacetoensurethatfoodwillnotcause harmtotheconsumerwhenitispreparedand/oreatenaccordingtoits

intendeduse.Itiscentraltoconsumersafety,publichealth,foodsecurityand keytofacilitationoflocalandinternationaltrade.Accesstosafefoodisa fundamentalrightasprescribedinArticle43asreadwithArticle46ofthe ConstitutionofKenya.Food safetyneeds tobeassuredbyprotecting the food supplyfromall typesofcontaminationandhazardsthatmayoccurduringall stages of food production,including growing,harvesting,processing, transporting,retailing,distributing,preparing,storingandconsumption.

  • 3.Internationalgoodpracticedoesnotmixfoodsafetyregulationwithmedicines regulation.Infoodsafety,theSPsAgreementencouragesWTOmembersto basetheirnationalmeasuresontheinternationalstandards,guidelinesand recommendationsadopted by theCodexAlimentariusCommission(CAC) whosesecretariatishostedbyFoodandAgricultureOrganization.Foranimal andplantlifeandhealth,measuresare tobebasedonthose standards adopted by Foodand AgricultureOrganization(FAO)from theWorld OrganizationforAnimalHealth(WOAH)andtheInternationalPlant ProtectionConvention(IPpC),respectively.TheRegulationsofmedicinesisnot undertheSPsagreementunderwhichFoodsafetyguidelinesandregulations aresetbytheWTO.Veterinarymedicinesareonlypartoffoodsafetyasfaras thoseusedonfoodanimalssincetheycanbeconsumedinmilkandmeatif appropriatewithdrawalperiodsarenotobserved.

Inthisregard,KenyaVeterinaryBoardappreciatestheroleofCountyGovernments infoodandfeedsafetyandrecommendsasfollows:

  • 1.TheregulationofFoodsafetyshouldbedoneseparatelyfromregulationof medicinesasguidedbytheSPsAgreementofWTOandotherinternational standardsettingbodiesascapturedinthepresentBill

2. TherevisedFoodSafetyPolicyandFood&FeedSafetyControlCoordination BillpublishedbyParliamentshouldbefasttrackedtoguaranteeconsumer safetyandfacilitatetrade.

  • 3.TheBilladdressesthecurrentchallengesinfoodsafetyregulationdevoidof anybusinessinterests and isbackedbyasoundFoodSafetyPolicy.
