TheAgricultural and LivestockExtensionServicesBill (SenateBillsNo.12of 2022) waspublishedon30tDecember,2022andreadaFirst Timein the Senateon Wednesday,15thFebruary,2023andthereaftertheBillstoodcommittedtotheStanding Committee onAgriculture,Livestock andFisheriesforconsideration.
IncompliancewiththeprovisionsofArticle118oftheConstitutionandStandingOrder 145(5)of theSenateStandingOrders,the Committeeproceeded toundertakepublic participation on theBill.In this regard,the Committeepublished an advertisement in theDailyNation andStandardnewspaperson Tuesday,21stFebruary,2023inviting membersofthepublictosubmitwrittenmemorandato theCommitteeontheBill. Additionally,the Committeesentinvitationstokeystakeholdersinvitingthemtosubmit theircommentsontheBill.
TheCommitteereceivedwrittensubmissionsfromtwo(2)stakeholders,namely the InspectorateService(KEPHIS).

TheCommittee thereafterproceeded toconsider extensively theprovisionsof theBill andthesubmissionsreceived thereon.Basedonitsdeliberations,theCommitteehas madevarious observationswhich areset out in Chapter Three of thisReport.Notably, thefinalrecommendationbytheCommitteeisthattheSenateproceedstoconsiderthe Agricultural and LivestockExtensionServicesBill,2022(SenateBillsNo.12of2022) with amendments.

1.1.Background
TheAgriculturaland LivestockExtensionServicesBill,2022(SenateBillsNo.12of 2022) seekstoprovideforthe agriculturaland livestock extensionservicesandestablish theAgricultural andExtensionService.TheBillwaspublished on30thDecember,2022 andreadaFirstTimeintheSenateonWednesday,15thFebruary,2023and thereafter theBill stood committed to theStandingCommitteeonAgriculture,Livestockand Fisheriesfor consideration andfacilitation ofpublicparticipation.TheBill published is attachedtothisReportasAppendix2.
TheBill proposes to setup an agricultural and livestockservicewhichismanaged by theBoard ofDirectors.TheBill provides for the establishment,powers,composition andfunctionsofgoverningbodiestooverseeAgriculturalandLivestockExtension Services in the country.
TheBill furtherprovidesfor assistance tofarmerstogain innewinformationand developnew abilities,aswell as to apply directly on the farm the latest scientific knowledgethroughthetransferoftechnology.
Theimportanceofagriculturalextensioninrelationtothefightagainstpovertyhasbeen underscored in theStrategy toRevitalizeAgriculture(SRA) (Republic ofKenya,2004). All agriculturalExtensionServicesAgenciesneed tohave astandard approach and objectivesinordertofeedinto anoverall nationalgoal.Uniformstandardsmustbeset, uniformscopeofoperation maintained,deliverymodel adopted by all agencies and extensionofficerstrained.
extension services in Kenya.The Bill,therefore seeks to provide a legislative frameworkfor extension services inKenya.Theobjectivesof theBill are to:
- 1.foster coordination in extension servicesresearch byNational Government, County Governments,non-governmental organizations,learning institutions, researchbodies,and othernon-state actors;
- 3.for thecontinuous and sustained research onextension services for the development of theAgricultural and livestock industry;
- 2.promote thegenerationof high incomeforfarmers and traders throughincreased productionandsourcingofcompetitivemarkets;
- 4.fortheadoptionofsector-wideapproach to theprovidedextensionservices which enables access to appropriate quality services which enables access to appropriatequalityservicesfrom thebestserviceprovidersand attainshigher productivity,increasedincomes,andstandardoflivingtoKenyans;andforthe

provisionoffinancial supporttothevariousplayersinthe extension services industry.
1.2.OverviewoftheBill
Clause4oftheBillprovidesfortheCabinetSecretaryshallformulateandpublishin the Gazette an agricultural and livestockextensionservicespolicyat least once every fiveyears,for theimplementationandstandarddeliveryofextensionservicesbythe countygovernments.
Clause5of theBillprovides that theCountyexecutivecommitteemember shall formulateandpublish,intheGazette,acounty-specificextensionservicesstrategy.The countyexecutivecommitteemember shall informulating thestrategy takeintoaccount thenational livestockpolicyformulatedbythe CabinetSecretary.
Clause8oftheBillestablishes theAgriculturalandLivestockExtensionService. Whosefunctionsinclude
- (a)enhance the competitivenessof the agriculture and foodindustryinKenyain an increasinglycompetitiveworld environment;
- (b)increase thelong-termproductivityof agriculture andfoodindustryinKenya while maintaining and enhancing the natural resource base on which the Countiesand theNational Government agricultural economydependon;
- (t) develop new uses and new products for agricultural commodities and come up with alternativeproductionmethodsto developnewcrops;
- (d) improve riskmanagement in the agriculture industry inKenya.
In theperformanceofitsfunctions,theserviceshall
- (a)support agriculturalresearch on extension services topromote economic opportunityinruralcommunitiesand tomeet theincreasingdemand for informationand technology transfer throughout the agriculture industry in Kenya;
- (b)collaboratewith the countygovernmentsin—
- i. improving the coordination and planning of agricultural research, extension,and teachingprograms;
- ii. identifyingneeds and establishingprioritiesfortheseprograms;
- iii. ensuring that national agricultural research,extension,and teaching objectives arefully achieved;and
- iv. ensuring that theresults of agriculturalresearchareeffectively communicated and demonstrated to farmers,processors,handlers, consumers,and all otheruserswhocanbenefitfromthem.
- ()maintain and disseminateinformation onstandardsforthe supplyofnutritious andsafefoodby thecountygovernments;
- (d)facilitate the transfer of technology;
- (e)encourage theuse ofinformation communication technologyby developing and packaginginformation in simple,easily accessible digital systems;
- f)collaborate with international entities in order to leverage resources,priority food and agricultural interests including addressing emerging plant and animal diseases,improving crop varieties and animal breeds,and developing safe, efficient,andnutritiousfoodsystems;
- (g)mobilizingresourcesatthenational levelforinvestmentinthedevelopmentand implementation ofextensionservicesprogramsin the counties;
- (h) developing and coordinating intergovernmental relations mechanisms in the deliveryofservicesrelatedto extensionservices;and
- (i)providingtechnical assistance andcapacitybuildingto thecountygovernments onmattersrelatingtoextensionservices.
Clauses9-17of theBilldealswith themanagementof theServicewhichisvestedon the Board of Directors consisting of-
- (a)a chairperson who shall be appointed by the Cabinet Secretary;
- (b)the principal secretary responsibleformattersrelating to agriculture;
- (c)theprincipal secretaryresponsibleformattersrelating tolivestock;
- (d)twopersonswithknowledgeandexperiencein thefieldextensionservices nominated by the Council of County Governors;
- (e)onepersonrepresentingnational farm orproducer organizationsnominated by theCouncilof CountyGovernors;
- Organizationnominated by the Organization;
- (g)onememberrepresentingtheNationalAssociationofAgriculture and Livestock ExtensionServiceProvidersnominated by the association;
- CabinetSecretary;and
- (i)thechiefexecutiveofficers.
Clause26oftheBillsetsouttheroleofthecountygovernmentas-
- (a)implement theNational Governmentpolicyand standardsrelating tothe extension servicessector;
- (b) regulate and promote extension services within the respective county;
- ()collect,collate anddisseminateinformation on the extensionservicesindustry including theappropriatetechnology andpracticestoensuremaximization of yields andsalesbystakeholders;
- (d)coordinate the activities ofpersons,organizations,and any other associations within thefieldofextensionservices;
- (e)facilitatetheaccessbyplayersinthe extensionservicessector to suchresources andfinancial support asmaybenecessarytopromote theuse anddevelopment of extension services in therespective county;and improve on the safe production andprocessingof,and addvalue to,Kenyanfood andfiberresources usingmethods thatmaintain the balance between yield and environmental soundness.
Clauses18-20of theBillestablishestheOfficeof theChiefExecutiveOfficerwho shall be the secretary to theBoard andshall,subject tothe directionof theBoard
- (a)beresponsible for the day-to-daymanagement of the affairs of theBoard;
- (b) manage the funds, property, and affairs of the Board;
- ()beresponsibleforthemanagementof thestaffoftheBoard;
- (d) oversee and coordinate the implementation of the policies,programmes, and objectivesoftheBoard;
- (e)cause tobepreparedfortheapproval of theBoard—
- the strategicplan and annual plan of theBoard; and
- ii. the annual budget and audited accountsoftheBoard;and
- f)perform such otherduties as maybe assigned by theBoard.
FINANCIALPROVISION
PartV(clauses 27-31) of theBill providesfor thefinancial provision of theBill.The Bill proposesthatthefundsoftheserviceshallinclude
- (a)monies appropriatedbyParliamentfor thepurposes of the service;
- (b)such monies or assets as may accrue to or vestin the service in the course of the exercise ofitspowersor theperformance ofitsfunctions under thisAct or any otherwrittenlaw;and
- ()donations,grants,loans,orgiftsmadeto theserviceand approved bythe Cabinet Secretaryforfinance.
Part VI(clauses 32-33)providesfor miscellaneous provisions.It provides areas in which county governments can legislate on,it also delegates powers to the Cabinet Secretarytomakeregulationson anymatterwhich isnecessaryorexpedienttobe prescribedforcarryingoutorgivingeffecttotheAct.
CHAPTERTWO
2.0.OVERVIEWOFPUBLICPARTICIPATIONONTHEBILL
PursuanttotheprovisionsofArticle118oftheConstitutionandStandingOrder145 (5)of the Senate Standing Orders,the Senate Standing Committee on Agriculture, Livestock and Fisheriesproceeded to undertakepublicparticipation on theBill.The presentationsweremadethroughwrittenmemoranda.
In this regard,the Committeepublished an advertisementin the Daily Nation and StandardnewspapersonTuesday,21sFebruary,2023(Appendix3)invitingmembers ofthepublictosubmitwrittenmemorandaontheBill.
In response to the advertisement and invitations,the Committee received written submissions from two(2) stakeholders,the Ministry ofAgriculture andLivestock Development (MOALD) and theKenya Plant Health Inspectorate Service (KEPHIS).
Detailed submissions by stakeholders,organized clause-by-clause,are set out in a matrixattachedasAppendix4.Additionally,copiesofthestakeholdersubmissionson theBill are attached collectively asAppendix5andnumbered1-2.
2.1.Submissionsfrom the Ministry of Agriculture and LivestockDevelopment
The Ministry outlined the following in their submission:
The object of theBill isnotclearly bringing outwhat theBill intends to address,i.e., to;provideforagricultural andlivestockextensionservices;Establish theAgricultural and Extension Service;andfor connected purposes.The objects should bereviewed to provide for the establishment of the agricultural extensionprofessional body andfor regulation ofextensionserviceprovision.
The National and CountyAgricultural and LivestockExtensionServices policies and strategiesareadministrativefunctionsandmaynothaveanyrelationtoextension serviceprovision.This makeslegislation of thisresponsibility unnecessary.
TheBill shouldbereviewed toprovideforthefunctionsthatentrenchprofessionalism inExtensionServiceDelivery.
The Bill be reviewed to provide strengthening of County services through the Board. ExtensionServices are devolved functions.By advising the CS,theservicewill only influencepolicyandnottheactual extensionbeingundertakenbythecounties.
Being a devolved function,Extension services should be allocated by the County Assemblies.In the case where the service is regulating a professional body then it shouldgenerateitsownfund.
Thereisneed tohave uniformregulationsin theBill to avoid heterogenousframeby having county specificregulationsforregistration,licenseissuance and renewal.
2.2.Submissions from the Kenya Plant Health Inspectorate Service (KESPHIS)
Kenya Plant Health Inspectorate Service outlined the following in their submission:

TheCommitteemadethefollowingobservations:
- 1.Agricultural extension has a significant role in improving agricultural productivity,boostingfood security,enhancinggrural livelihoods.Theyprovide significant support to rural farmers in meeting the new challenges confronting agriculture;
- 2.Kenya and theworld at large arefaced by effects of climate change,which has significantly distorted the weather patterns.In therecentyears the amount of rainfall received hasbeen dwindling and therefore there isaneedtocomeup withnewfarmingmethods and techniqueswhichwill bolsterthe harsh climatic conditions.
- 3.In addition,there hasbeen a sharprise of resistant pests and diseaseswhich affect bothcropsandlivestockandthereforeprovisionofextensionservicestofarmers will be essential in compacting these emerging challenges in the agriculture sector;
4. The passage of the Bill is essential because it addresses the issues highlighted above and therefore the committee seeks the support of the house topass the Bill;
- 5.Thecommitteeconcurswith theviewsofMOALD thatExtensionServicesare devolvedfunctionsand therefore thereis a needto amend theBill tocapture this aspect;
- 6.Extension services have a direct effect on food security of the Country and thereforethenational Governmenthasaroleinsettingpolicies andstandardsfor theprovisionofextensionservices;
- 7.TheMOALDSubmitted that since extension services are devolved,the County assemblesshouldbetaskedwiththeallocationoffundstotheAgricultural and
LivestockExtensionService.TheCommitteehowever disagreeswith theviews because the Extension Service is a national government agency comprising of representativesofboth theNational Government and thecountygovernments. Further,the service is tasked with performing functions of both arms of government;and
- 8.There were a few typographical errors in theBill.

Thecommitteerecommends asfollows:
- 1.That,various typographical errors appearing in the Bill be corrected;
- 2.That, clause 5(1) be amended to replace"Livestock policy "to read"Agricultural and livestockpolicy";
- 3.That,clause8andclause14on thefunctionsoftheService and theBoard,be amendedtoassignfunctionstoboth thenationaland thecountyGovernmentsin linewiththefourthScheduleoftheconstitution;and

Inhispresentation,thepetitioner drew theattentionof theCommitteeto theWestKano IrrigationScheme(TheSCHEME)graft.Heexplained that thegraftshadgenerated tensions, economicmelt-down and acrimony in the society. The scheme is situated inKisumu County, KadiboSubCounty,KawinoNorthLocationandhasa land acreageof2230Ha.
Heinformed the Committee thatbetween2009and2021,thescheme hadreceived the followingfunds:
- a) RehabilitationFund(theGovernmentoftherepublicofKenya);
- b) Economic StimulusPackage Fund (the Government of the Republic of Kenya);
3. FarmersSavingFund(Farmers);
- d) Farm Machineries/Accessories(13 Tractors)Fund(the Governmentof the Republic ofKenya,the Government of theRepublicof Japan);and
- e) )RiceSalesFund(the GovernmentoftheRepublicofKenya).
Issuesraised bythepetitioneron thefunds are:
- 1.The scheme has never been audited since inception and EACC is not willing to audit the scheme;
- 2.OnAugust19th2015,thepetitionerreported thefirstdeeplyentrenchedWestKano IrrigationSchemeFarmersRevolvingFundandtheNationalIrrigationBoardGraft. (EACCReportNo.52966SubfilecoveringReport(EACC/KSM/FL/NO/89/2015). ThegraftinvolvedtheGovernmentRehabilitationFund,EconomicStimulusPackage Fundand theFarmersOwnSavingsFund.EACCWesternRegional OfficeKisumu received the report and launchedan investigation and that the EACCWestern Regional Office,Kisumu has forever continued to investigate the Graft.No conclusionhasbeenmadetodateontheEACCinvestigationsoftheschemegrafts;
- 3.TheSecondWestKanoIrrigationSchemeCooperativeSocietyLimitedGraft to EACCWesternRegionOffice,Kisumu(EACCReportNo.542851)wasreportedby thepetitioner.Thegraftinvolvedmisappropriation of tractors and accessoriesgranted by theGovernmentof theRepublicofJapan.WestKanoIrrigationSchemewas granted13 tractors and anumberof accessorieswhichagainwere embezzled and the programstalled;and
4. TheOfficeof theOmbudsmanWesternRegional Office,Kisumunotedwithgreat concernasindicatedon theirLetter to theSchemeManageron28thSeptember,2017 which states thatUpon careful analysisof the response(s),it emerged that the same wasshroudedwithsomeinconsistencieswhichintheirviewpresentedthatitmight amount toallegationsofcorruption".TheCommission on Administrativejustice terminated thecasescitingthattheEACCWesternRegional Officeconfirmedhaving renderedtothemtherequisitelegaladvicetowardsresolutionofthematter.
Thepetitionersprayed thattheCommittee:
- 1.Carry outa thoroughfinancial inspectionoftheSchemebetween2007-2021;
- 2.Carry outinstitutional Audit of the schemes since inception;
3. CarryoutForensic(Indepth)auditofallofficialsinvolvedinthemanagementofthe schemebetween2007-2021;

OBSERVATIONS
- (i) that the2023 BPS have been prepared againsta backdrop of global economic slowdown occasioned by a number of factors including;the ongoing Russia-Ukraine conflict,high global inflation,lingering effects of the COVID-19 pandemic,and persistent supply chain disruptions;
- (il) that the Kenyan economy remains highly dependent on the agriculture sector, contributingon average21.4percentof theGDPdirectly,formingapproximately65 percentofKenya'stotalexportsandhas thehighestemploymentmultiplierin the economy;
- (ii) that the2023BPShasbeen submittedata timewhen theCountry'seconomyisfacing anumberofchallengessuch as theprolonged droughtwhich has affected agricultural outputand theprevailinghighcostof livingand amidgovernment'splans to introduce austerity measuresintended atcurtailing accumulation of debt;
- (iv) the agriculturalproductivityin thecountryhasbeendeclininglargelyoccasionedby theprolongeddroughtasaresultof failedrainandhighglobal fertilizerprices resultinginseverefoodshortage;
- (v) that thespreadof theCOVID-19pandemicworsenedthe situationwithworld fertilizerpriceshavingmore than doubledinthepasttwoyears,affectingproductivity ofKenyanfarmers;
- (vi) farmers'access to local and international markets.The market disruption has impactednegatively on theAgriculturalsector;
- (vii) thatAgricultureSectorisaDevolvedfunctionasperSchedule4oftheConstitution and Counties are not allocating adequateresources to theAgriculture,Livestock and FisheriesSectoryetit is thehighestcontributor to GCP;
- (ix) that theAgriculturalsectorbeingoneofthefivecore thematic areas that areexpected tohavethehighestimpactatthebottomof theeconomy,fivepoliciesofthe governmenthavebeengivenpriority,howevertheresourcestowardsthesame arestill inadequate andstillbelowtherequirementof10%resourceallocation;
- (viii) that inadequate financial resources for the agricultural sector limits increasing production and investment in value addition activities in agriculture;
- (x) the AgricultureSectorhas·a totalallocationofKshs.75.6billion,Kshs.85.6billion andKshs.91.6billionforFY2023/24,FY2024/25andFY2025/26respectively. This comprisesofKshs.32.2billion,Kshs.34.5billionandKshs.36.5billion for recurrent expenditure andKshs.43.4 billion,Kshs.51.1billionandKsh.55.0billion for developmentexpenditureforthesameperiod;
- (xi) countiesbenefitfromAdditionalallocationsfromthedevelopmentpartnersinformof loans and grants to support agriculture,Livestock and fisheries sector as conditional allocations;
- (xii) Agriculture,Livestockand Fisheriessectorwillreceiveanadditionalallocationof Kshs.2,965.7milliontowardstheSweden-AgriculturalSectorDevelopmentSupport Programme(Kshs.72.7million),WorldBank-EmergencyLocustResponseProject (Kshs.2,302.6million),Kenya Livestock Commercialization Project (Kshs.344.3 million) and Aquaculture BusinessDevelopmentProject(Kshs.245.9million);and
- (xiii) theresourcesprovidedinAgriculturesectorunder theBPSmaynotbeadequateto realizetheBottom-UpEconomicTransformationAgenda.
RECOMMENDATIONS
In view of the above observations,the Committee made the following Policy Recommendations;-
- (# TheNational Treasury shouldprovide additional funding toreduce the fundinggap on thebudgettothestatedepartmentsandbaseitontheMaputodeclarationof10% ofthewholebudgetand thisshouldbereplicated attheCountylevels,owingtothat thepoliciesunder thesectoraredirectdriversin theachievementoftheBottom-Up transformationAgenda.
- (iii) The CountyGovernmentsneed tohave a databankoffarmers toensure theintended beneficiariesreceivethesupportto avoidmismanagementof thesubsidy.
- (ii) The County Governments should allocateresources in support of the National GovernmentPolicyofreducingpost-harvest lossesin theAgricultureSector;
- (iv) TheNationalgovernment should have plans and strategies inplace and well espoused in thebudgetpolicy statementwith theobjectiveofmaking thecountry foodandnutritionsecure.
- (v) TheMinistry ofAgriculture,Livestock,Fisheries and Cooperatives to strengthen the
- support services including agricultural extension services for improved and sustainable productivity of agriculture.Though the function is devolved,the committeeresolvedforapushforaconditionalfundingasagrant totheCounties.
- (vi) Arising from the worsening drought conditions,the National government should facilitate more food supply in northern Kenya and other regions and enhanced coordination between National and County Governments,private sector and development partners through the National Steering Committee on Drought Response to cushion communities affected by drought,especially in the worst-hit arid and semi-arid(ASAL).
- (vii) Climate change and lackofextension services-In order topromote agricultural extensionservices,theNationalGovernmentshouldprovideaconditionalgrantto county governments towards the extension servicesprogramme to ensure farmersget appropriate production techniques.This will maximize yield in agricultural production,TheNationalgovernmentistocomeupwithapolicyonprovisionof agricultural services andmayprovidefundingsupportwherenecessary.
- (vii) Water harvesting forirrigation-The provision ofwater for irrigation in addition to theprovision ofsubsidizedinputsand extension services canbe awholesome solutionto thecurrentchallengeof agricultural productivity.
- (ix) Agriculturalextension service isa critical tool for improving productivity and therefore,Countiesmusttakeupitsroleandfacilitateagriculturalextensionofficers tocarryouttheiractivities.
- (x) High post-harvest losses- TheNational Government should arrest thehuge postharvestlossesandeffectivelyaddressedasastrategytoachievefoodSecurity

AN ACT of Parliament to;provide for agricultural and livestock extension services; establish the Agricultural and Extension Service; and for connected purposes.
ENACTEDbytheParliamentofKenya,asfollows-
PARTIPRELIMINARY
- 1.ThisActmay becited as theAgricultural and livestock ExtensionServicesAct,2022.
- 2.In this Act,—
"Board"means theBoard establishedunder section8;
"Cabinet Secretary"means the Cabinet Secretary responsible formattersrelatingtoagriculture;
"chief executive officer"means the person appointed in accordancewith section18;
"extension services";means agricultural and livestock extension services;and
"county executive committee member"means the county executivecommitteememberresponsibleformattersrelating to agriculture.
- 3.The objects of thisAct is toprovidefor a framework—
- (a) tofoster coordination and collaborationin extensionservices researchbyNational Government, County Governments, nongovernmental organization,learning institution, research bodies and othernon-state actors;
- q topromote thegenerationofhighincomefor farmers and tradersthroughincreasedproduction and sourcingofcompetitivemarkets;
- for the continuous and sustained research on extensionservicesforthedevelopmentof the Agricultural and livestockindustry;

- (d)for adoption of a sector-wide approach to the provision extensionserviceswhichenables access toappropriatequalityservicesfromthebest increased incomes andstandard of living to Kenyans.; and

PARTII-NATIONALANDCOUNTY AGRICULTURALANDLIVESTOCKEXTENSION SERVICESPOLICYANDSTARTEGY.
- 4.(1) The Cabinet Secretary shall,formulate andpublish in the Gazettean agricultural andlivestockextensionservicespolicy at leastonce every five years,for the implementation and standarddeliveryof extension services bythecounty governments.
- (2)In developing theNational extensionservicesPolicy,the CabinetSecretaryshall haveregard to
- (a)theneedforaneffectivemanagementand implementationstructureatthenationalandcounty levels ofgovernmentin order toensure the effective development of themungbeanindustry;
- (b) adequate capacity development and support for growers and other stakeholdersin the mung bean industry;
- (c)theparticipationofstakeholdersandcommunitiesat thenational and countylevelsofgovernment;
- (d)thedevelopmentofappropriatestrategiesand mechanisms atthenational andcountylevelsof governmentnecessarytosupport thedevelopment of themungbeanindustry;
- (e)theneed tohaveinplaceaframeworktomonitor andevaluate theimplementationofthepolicyin the developmentandregulationof themungbean sector;
- (f)theresourcesrequired at thenational and county levelsofgovernmentfortheeffective implementation of thepolicy;and
- (g)thecapacitybuildingprogrammes and strategies neededtobecarriedouttoensurethatgrowers are

- (3)The Cabinet Secretary shall periodically review the national agricultural and livestock extension services policy and may,by notice in the Gazette,publish a revised national agricultural and livestock extension servicespolicy.
- (4) The Cabinet Secretary,each county executive committee member and all relevantpublicbodies shall,when exercising or performinganystatutoryfunction,takeinto accountandgiveeffect to thenational agricultural and livestock extension servicespolicy.
- 5.(1)Each county executive committee member shall formulate andpublish,in the Gazette,a county specific extension services strategy.The county executive committee member shall in formulating thestrategy take into account thenational livestock policyformulated bytheCabinetSecretaryunder section4.
- (2)Thecounty executive committeemember shall periodically review the county agricultural and livestock extension servicesstrategy andmay,bynoticeintheGazette,publisha revised county agricultural andlivestock extension services strategy.
PARTIII-THEAGRICUTURALANDLIVESTOCK EXTENSIONSERVICE
- 6.(l) There is established the Agricultural and Livestock Extension Service.
- (2)TheService shall be a bodycorporatewithperpetual succession and a common seal and shall,in its corporate name,be capable of
- (a)suing and being sued;
- (b) taking, purchasing or otherwise acquiring, holding,charging and disposing of movable or immovable property;
- C entering into contracts;
- (d)borrowing and lending money;and

- doingorperforming all such otherthingsor acts as maybenecessaryfortheproperdischargeofits functionsunderthisAct,whichmaybelawfully doneorperformed by a bodycorporate.
- 7.(1)Theheadquarters of the service shall beinNairobi.
- (2)Theservicemayestablish suchotherofficesanywherein Kenyaasitmayconsidernecessaryfortheeffective performance ofitsfunctionsunder thisAct.
- 8.(1)ThefunctionsoftheServiceshall beto
- (a)enhance the competitivenessof agriculture and food industry in Kenya in an increasingly competitive world environment;
- (b)increase thelong-termproductivity of agriculture andfood industry in Kenya while maintaining and enhancing the naturalresourcebaseonwhichtheCountiesandthe National Government agricultural economy depend on;
- ()developnewusesand newproducts for agricultural commodities and come up with alternative production methodstodevelopnew crops;
- (d)improve risk management in the agriculture industryin Kenya;
- (2)in performance of its functions under subsection (1),the serviceshall
- (a)support agricultural researchon extension servicesto promoteeconomicopportunityinrural communitiesand tomeettheincreasingdemandforinformation and technology transfer throughout theagriculture industryin Kenya;
- (b)collaboratewith the countygovernments in—
- (i)improving the coordination and planning of agricultural research, extension,and teaching programs;
- (ii)identifying needs and establishingprioritiesfor theseprograms;
- (i) ensuring that national agricultural research, extension,and teaching objectives are fully achieved;and
- (iv)ensuring thattheresultsofagriculturalresearch areeffectivelycommunicatedanddemonstrated

- (b)collaboratewith internationalentitiesin order toleverage on resources,priority food and agricultural interests including addressing emergingplant and animal diseases, improving cropvarieties and animal breeds and developing safe,efficient,and nutritious food systems;
- (c)mobilisingresources at thenational level forinvestment in development and implementation of extension services programs in the counties;
- (d) developing and coordinatingintergovernmentalrelations mechanismin thedeliveryofservicesrelatedtoextension services;and
- (e)providing technical assistance and capacitybuildingto the countygovernmentsonmatters relatingtoextension services.
- BoardofDirectors 9.The management of the service shall vest on the Board of Directors.
- 10.(1) TheBoard shall consist—
- (a)a chairperson who shall be appointed by the Cabinet Secretary;
- (b)the principal secretary responsible for matters relating to agriculture;
- (c)the principle secretary responsible for matters relating to livestock;
- (d)two personswithknowledge and experience in the field extensionservicesnominated by the Council of County Governors;
Qualificationsfor appointmentasa member.
Tenureof appointment.
Vacationof office.
- (e)one person representing national farm or producer organizations nominated by the Council of County Governors;
- (f)one person representing theKenya Agricultural and LivestockResearch Organizationnominatedbythe Organization;
- (g)onememberrepresenting the National Association ofAgricultureandLivestock Extension Service Providers nominated by the association;
- (h)onepersonrepresenting extension services training institutionsnominated the CabinetSecretary;and
- (i)thechiefexecutiveofficer.
- (2)TheCabinetSecretaryshall appointthemembersunder subsection (1) (d),(e), (f),(g) and (h) by notice in the Gazette.
- (4)The chief executiveofficer shall bean ex officio memberandsecretaryto theBoard andshallhavenorighttovote at anymeetingoftheBoard.
- 11.(1)Aperson isqualifiedforappointment asamemberof the Board under section 10(1) (e),(f),(g)and (h) if that person—
- (a)is a citizen of Kenya;
- (b)holds a degree from a university recognized in Kenya;
- ()has at least three years'experience inmanagement; and
- (d)meets therequirementsofleadershipandintegrity setoutin ChapterSixoftheConstitution.
- (2)Aperson is not qualified for appointment if that person--
- (a)is convictedofa criminaloffence and sentenced to a termofimprisonmentofatleastsixmonths;
- (b)is a member of Parliament or county assembly;or
- (c) is adjudged bankrupt.
- 12.Apersonwhois appointedunder section10shall servefora termofthreeyearsrenewableforonefurtherterm.
- 13.Aperson shall cease tobeamember of theBoard if that person—

- (a)is absent, without reasonable cause,for three consecutivemeetingsoftheBoard;
- (b) becomesanofficer,agentormemberofstaffofthe Board;
- resigns bygiving a noticein writingaddressed to the CabinetSecretary;
- (d)is convicted ofa criminal offence and sentenced to a termofimprisonmentofatleastsixmonths;
- (e)is declared bankrupt;
- (g)is unable to perform the functions of officeby reasonofmentalorphysicalinfirmity;or
- (h) dies.
- 14.(1) ThefunctionsoftheBoard shall be to—
- (a)makerecommendations to the Cabinet Secretary and the county governments on the implementation of strategies,plans and policies relating to the extensionservices;
- (b)advise the Cabinet Secretary and the County governmentsonPriorityareasofExtensionService programs and theroleof Non-state actors andother Extension ServiceProvidersin line with thePolicy;

- (2)TheBoard shallconsult and collaboratewith thecounty executivecommitteemember in thedevelopment,promotion and regulation of the extension servicesin therespectivecounties.
- 15.(1) The Board may establish such committees as it may considernecessaryfortheefficientperformanceofitsfunctions and theexerciseofitspowersunderthisAct.
- (2) TheBoardmay co-optanyperson to sit in acommittee establishedunder subsection(l)suchpersons whoseknowledge and skillsarefound necessaryfor theperformance of thefunctions oftheBoard.
- 16.The Board may,by resolution either generally or in any particular case,delegate to any committee,member,officer, employeeoragentoftheBoard,theexerciseofanyof the powersor theperformanceofanyof thefunctionsof theBoard underthisActorunderanyotherwrittenlaw.
- 17.Themembers of the Board shallbepaid such remuneration, fees or allowances as the Cabinet Secretary shall,in consultation with the Salaries and Remuneration Commission, determine.

- (a)is a citizen of Kenya;
- (b)holds a degree from a university recognized in Kenya;
- (c)has at least ten years'experience in senior management;and
- (d)meets the requirements of leadership and integrity set outin chapter sixof the Constitution.
- (3)Thechiefexecutive officer shall holdofficefor a term offiveyears andiseligibleforre-appointmentfor onefurther term.
- 19.Thechiefexecutiveofficershall be thesecretary to theBoard and shall,subject to the directionof theBoard
- (a)beresponsiblefor theday to daymanagementof the affairs oftheBoard;
- (b)manage the funds,property and affairs of the Board;
- ()beresponsiblefor themanagementof the staffof the Board;
- (d)oversee and coordinate the implementation of the policies,programmes andobjectives of theBoard;
- (e)cause tobepreparedfor the approval of theBoard
- (i) the strategic plan and annual plan of theBoard;and
- (ii) the annual budget and audited accounts of the Board; and
- (f)perform such other dutiesasmaybe assigned by the Board.
- 20.Thechiefexecutiveofficer shallceasetoholdofficeifthat person-
- (a)resigns in writing,addressed to the Board;
- (b)is convicted of a criminal offence and sentenced to a

- (2)The persons appointed under subsection (l) shall be competitivelyrecruitedandappointedbytheBoardandshallserve on such terms and conditions as the Board may,in consultation with theSalaries andRemuneration Commission determine.
- (3)The staff appointed under subsection (1) shall possess suchknowledgeand experience as shall be determinedby the Board.
- 22.Liability shall not attach to theBoardor to anyof itsmembers, officers,agentsorstaffforlossor damageincurredby aperson as aresult ofan actor omission doneormadeingoodfaith and without negligence in theperformance or exercise or the intendedperformanceorexerciseofanydutyorpowerimposed byor conferred under thisAct.
- 23.(1) The common seal of theBoard shall bekept in the custody ofthechiefexecutiveofficerorsuchotherpersonastheBoard may direct,and shall not be used except upon the order of the Board.
- (2)The sealof theBoard shallbeauthenticatedbythe signature of the chief executive officer and the chairperson or a persondesignatedbytheBoardforthatpurposeonbehalfofthe chairperson.

- 25.(1) The business and affairsof theBoard shall be conducted in accordancewith theprovisionssetoutintheFirstSchedule.
- (2)Except as otherwiseprovided in theFirst Schedule,the Boardmayregulateitsown procedure.
- (3)TheBoardmayinvite anyperson toattend anyof its meetings and to participate in its deliberations,but such person shallnotbeentitledtovoteon anyoftheBoard'sdecisions.
PART IV ROLE OF COUNTY GOVERNMENTS
- 26.(1) Each county government shall
- (a)implement the National Government policy and standardsrelatingto theextension servicessector;
- (b)regulateandpromoteextensionserviceswithin the respective county;
- ()collect,collate and disseminateinformation on extensionservicesindustryincludingthe appropriate technology andpracticestoensuremaximisationof yields andsalesbystakeholders;
- (d) coordinate the activities of persons,organisations andanyother associations withinthefieldof extensionservices;
- (e)facilitateaccessbyplayersin theextensionservices sector tosuchresources andfinancial support asmay benecessarytopromote theuseand developmentof extension servicesin therespective county;and
- (f)improve on the safe production and processing of, and adding ofvalue to,Kenyan food and fibre resourcesusingmethods thatmaintain the balance betweenyield andenvironmental soundness.
- (2) Each county executive committee member shall,in subsection (1)-
- (a)maintain an up to dateregister of extension services providers as it considers appropriate in that county;

- (f)collaborate with relevant institutions so as to promote access to credit and otherfinancial services; and
- (g)carry out such otherfunctions as maybe conferred uponbyanylaw.
PARTV-FINANCIALPROVISIONS
- 27.(1) Thefundsof theService shall consistof
- (a)monies appropriated byParliamentfor thepurposes ofthe service;
- (b) such monies or assets asmay accrue to orvest in theserviceinthecourseoftheexerciseofits powersor theperformanceofitfunctionsunder thisAct or anyotherwritten law;and
- ()donations,grants,loans orgiftsmadeto the service and approvedbytheCabinetSecretaryforfinance.
- 28.(1) Atleastthreemonthsbeforethecommencementofeach financial year,theBoard shall cause to beprepared estimates of therevenueand expenditureoftheBoardforthatyear.
- (2) The annual estimates shall make provision for all estimatedexpenditureoftheBoardforthefinancialyearconcerned.
- (3) The annual estimates prepared by the Board under subsection (2) shall be submitted to the Cabinet Secretary for tablingin theNationalAssembly and theSenate.

- 29.(1) TheBoard shall cause tobekeptsuchbooksof accounts and other books in relation thereto of all itsundertakings,funds, activities andpropertyas theCabinetSecretarymayfrom time totimeapproveandshall,within aperiodofthreemonthsafter the end of the financial year,cause to be prepared,signed and forwarded to theAuditor-General-
- (a)a balance sheet showing in detail the assets and liabilities of theBoard;and
- (b)such other statements of accounts as the Cabinet Secretarymayapprove.
- (2)The accounts of theBoard shall be examined,audited andreporteduponannuallybytheAuditor-Generalin accordance with thePublicAuditAct.
- (3)The Board shall submit to the Auditor-General all books and accounts of the Board,together with all vouchers in support thereof,and allbooks,papers andwritings initspossession orcontrolrelatingthereto,andtheAuditor-General shall beentitled torequire from any member,officer,employeeor agentof the Board such information and explanation as hemay consider necessaryfortheperformanceofhisduties.
- 30.(1) The Board shall,within aperiod of three months after the endofeachfinancialyearorwithinsuchlongerperiod as the CabinetSecretarymay approve,submit to the CabinetSecretary areportoftheoperationsoftheBoard duringsuchyear,and the yearlybalance sheet and such other statementsof account as the Cabinet Secretary shall require,together with the AuditorGeneral'sreport.
- (2)The Board shall,if the Cabinet Secretary so requires, publish thereport,balance sheet andstatementssubmitted tohim under subsection(1) in suchmanner as the Cabinet Secretary may specify.
- (3)The CabinetSecretary shall submit to theNational Assembly and theSenate thereports,balance sheet and statements submitted under subsection(l),within a period of fourteen daysof thereceiptofthereports and statements.
- 31.Thefinancialyearof the service shall be theperiod of twelve months endingon thethirtiethof Junein eachyear.

PROVISIONSRELATINGTOTHECONDUCTOF BUSINESSANDAFFAIRSOFTHEBOARD
- 1.(1) The Board shall have at least six meetings in every financialyear andnotmorethantwomonthsshallelapsebetween the date of one meeting and the date of the next meeting.
- (2)Meetingsshall be convenedbythechief executiveofficer in consultationwith thechairperson andshall beheld at such times and suchplaces as the chairperson shall determine.
- (3) The respective chairpersons shall preside over all meetings andin the absence of the chairperson,by a person elected
- (4) The chairperson may at any time convene a special meetingoftheBoard as thecasemaybe,and shall dosowithinone monthof thereceiptbythechairperson ofawrittenrequest signed byatleastfiveothermembers.
- (5)Unlesshalfof themembers of theBoard otherwise agree,atleast seven days'noticeof a meeting shall be given to everymemberoftheBoardasthecasemaybe.
- 2.Thequorum ofa meeting of theBoard is halfof the total numberofmembers.
- 3.Adecisionof theBoard shallbebyamajorityofthe memberspresent andvotingand,in the case ofan equalityofvotes; the person presiding at themeeting shall have a second or casting vote.
- 4.Minutes of all meetings shall bekept and entered in records kept for that purpose.
- 5.(1)If a person is present at a meeting of the Board or respective committee atwhich anymatter is thesubjectof consideration and in which matter that person is directly or indirectlyinterestedinaprivatecapacity,thatperson shall as soon asispracticableafter the commencementofthemeeting,declare suchinterest.
- (2) The person making the disclosure of interest under subsection(1) shall not,unless theBoard or committee otherwise directs,takepartinanyconsideration or discussion of,or vote on anyquestiontouchingonthematter.
- (3)A disclosure ofinterestmadeundersubsection(1) shall be recordedin theminutes of themeeting atwhich itis made.
- (4)A person who contravenes subsection (1) commits an offence anduponconviction isliabletoa finenotexceedingfive
hundred thousand shillings or toimprisonment for a termnot exceedingsevenyears or toboth suchfine and imprisonment.
(5)Amember or employeeof theBoard shall not transact any businessortradewiththeBoard.
MEMORANDUMOFOBJECTSANDREASONS
TheprincipalobjectofthisBillistoprovideforthepolicyandinstitutionalframework withinwhich the agricultural and livestockindustry operates by among others establishing theAgricultural and LivestockExtension Service,which will bemanaged by ta Board of Directors.Agriculture is the backbone of our economy.Majority of Kenyans depend on agricultureeitherdirectlybyfeeding theirfamiliesorthroughtradingofagriculturaland livestockcommodities togenerate anincome.Unfortunately,over theyears thereturnshave been dwindling due tomainlypoorperformanceof both crops andlivestockwhich can be attributed to climate change,poor productionmethods,pest and diseases among others.
Thereis therefore a genuine need to setupapolicy andinstitutionalframework to support andguidetheactivities,operations,andinteractionswithin theindustrywith theaim thatthe growthof theindustrywill result to a strengthened agriculturaleconomyfor thevarious counties across the country.
Thehighlightof thisBill is thesettingupof abodywhichwill be dedicated towardscoming upwith policies and strategies on extension services.TheBill proposes toinvest inresearch soascomeupwithcropsandlivestockbreeds thatwill mature fastandalsobe able to withstand the current harsh climate.It sets up the roles of the county governmentswhich will be to implement thenational governmentpolicyin the counties and also tocoordinatevarious extensionservicesatthecountylevel.
Part I (clauses 1-3) contains preliminary matters.It contains the short title,interpretation of terms and theobjectoftheAct.
Part II (clauses 4-5) provides for the National Agricultural and livestock policy and strategy whichwill guide both thenational and the countygovernmentsinexecutingtheirmandates in relationtoextensionservices.
PART III(clauses 6-25) provides for the establishment,functions and powers of the Agricultural and LivestockService.Itfurtherprovidesforthecomposition andqualifications forappointmentofthemembersof theService.Inaddition,itprovidesfortheofficeofthe chiefexecutiveofficeroftheBoard and thesecretariat.
Part IV(Clause 26) contains provisions related to the role of county governments in regulatingextensionservices.
PartV(clauses27-31) sets out thefinancialprovisionsofService.It sets out the sources oft fundsfor the service.It alsoprovidesfor thepreparation ofannual estimatesofincome and expenditureof theBoard.Itfurtherprovidesfor theperiodof thefinancialyearof theBoard and thepreparation and auditingofits accounts.
Part VI(clauses 32-33) Sets out the miscellaneous provisions.It sets out areas in which countiescanlegislateoninregards toextensionservicesandalsodelegatespowersto the CabinetSecretary to makeregulations.

THATclausc4of theBillbe amcndcd by deletingsub-clause(2) and substituting thercforthefollowingnewsubclause
- (2)Indeveloping theNational ExtensionServiccsPolicy,the Cabinet Sccrctary shall have regard to
- (a)thenccdforan effectivemanagcmcntandimplemcntation structure at the nationalandcountylevclsofgovernment in order to cnsure the effectivc devclopment of the extension scrvicesindustry;
- (b)adcquate capacity devclopment and support for stakcholders in thc extension services industry;
- (c)theparticipationof stakcholdersandcommuniticsatthenationaland county levclsofgovcrnment;
- (d)the development of appropriate strategics andmcchanisms at the national and countylevclsofgovcrnmentneccssaryto support thedevelopmcnt of theextension servicesindustry;
- (e)theneedtohaveinplacea framcwork tomonitor andevaluatethc implementation of thepolicyin the development andregulation of thc extension servicesindustry;
- (f)theresourcesrequired atthenational andcounty levelsofgovernmentfor theeffectiveimplementation of thepolicy;and
- (g) the capacitybuildingprogrammcs and stratcgicsnceded to becarricd out to cnsure thatcxtension servicesproviders are able torespond to thenecds identificdfor the implementation of thepolicy.

THAT clause 5 of the Bill be amended by deleting sub-clause(1)and substituting thereforc thefollowingnew clause(1)-
(1)Eachcountyexecutivecommittcemcmbershall formulateandpublish,inthc Gazette,acountyspecificextcnsionservicesstratcgy andshall,informulatingthe stratcgy takeintoaccountthenational agricultural andlivcstockpolicyformulatedby theCabinctSecrctaryunder section4.

- (c) devclopnewuses andnewproducts for agricultural commodities and come upwith alternativcproductionmcthods to develop ncw crops; and

- (b)collaboratewith thecountygovernmentsin
- i. improvingthe coordination andplanningofagricultural rcscarch,extension,and teaching programs;
- ii. identifyingnecds and establishingpriorities for these programs;
- iili. cnsuring thatnational agricultural rescarch,extension, and tcachingobjcctives arefullyachicved;and
- iv. cnsuringthat theresultsofagriculturalrcscarch areeffcctivclycommunicatedanddemonstratedtofarmers, proccssors,handlers,consumers,and all otherusers whocanbenefitfrom them.
- ()maintain and disscminateinformation on standardsfor supply ofnutritiousandsafefoodbythecountygovernments;
- (d)facilitate transfer of technology;
- ()encourage theuseofinformation communication technology by devcloping and packaging information in simple, easily accessible digital systems;
- ()collaboratewithinternational entiticsin order toleverage onresources,priority food and agricultural intcrcsts including addressing cmcrging plant and animal discases,improving crop varictics and animal brccdsand devcloping safe,efficicnt,and nutritious food systems;
- (g)mobilisingresources at thc national level forinvestment in developmentandimplcmcntationofextensionservicesprograms in the countics;
