A Bill for

  • AN ACT of Parliament to amend the Political Parties Act,2011

ENACTEDby theParliamentofKenya,asfollows-

1. This Act may be cited as the Political Parties (Amendment) Act,2022. 2. 2.Section 10 of the Political Parties Act, 2011 is amended by inserting the following new subsections immediately after subsection (4) 3. "(5) The Registrar shall, within fifteen days of receipt of a coalition agreement deposited under this section, convey a certified copy of the agreement to the Clerk of each House of Parliament.

(6) ) In conveying an agreement -under subsection (5), the Registrar shall indicate the date on which the agreement was deposited."

3. (1) The Registrar of Political Parties shall, within 2. seven days of the commencement of this Act, convey a certified copy of any coalition agreement entered into and deposited with the Registrar before the commencement of this Act.

  • (2) In conveying an agreement under subsection (1), the Registrar shall indicate the date on which the agreement was deposited.

Short title.

Statement of objects and reasons for the Bill

The principal object of this Bill is to amend the political Parties Act, 2011 to require the Registrar of Political Parties to convey to the Clerk of her office. The agreements shall be useful to the Houses of Parliament in relation to determination of questions on theentitlement of parties and coalitions that are tied to their number of Members ineach House. The amendment further requires the Registrar to convey any agreement existing as at the commencement of its provisions to the Clerk of each House of Parliament.

The Bill seeks to implement the resolutions made by the 12th

Parliament in its approval of the 5th Report of the Procedure and House Rules Committee on Amendments to theStanding Orders.

Statement on the delegation of legislative powers and limitation of

fundamental rights and freedoms

This Bill does not delegate legislative powers nor does it limit any fundamental rights and freedoms.

Indication of whether the Bill concerns county governments

This Bill concerns county governments.

Statement as to whether the Bill is a money Bill within the meaning of

Article 114of the Constitution

The enactment of this Bill shall not occasion additional expenditure of public funds.

Section 10 of No. 11 of 2011 that is proposed to be amended-

Coalitions

10.(1) Two or more political parties may form a coalition or a coalition political party before or after an election and shall deposit the coalition agreement with the Registrar.

(2) -A coalition agreement entered into before an election shall be deposited with the Registrar at least three months before that election.

Provided that in the case of a coalition political party, the coalition political party shall submit the coalition agreement at least one hundred and twenty days before a general election.

(3) A coalition agreement entered into after an election shall be deposited with the Registrar within twenty-one days of the signing of the coalition agreement.
