ENACTEDbytheParliament ofKenya,asfollows -—
PARTI-PRELIMINARY
- 1.This Act may be cited as the Agricultural and livestockExtensionServicesAct,2022.
- 2.In this Act,-
"Board"means the Board established under section 9;
"Cabinet Secretary"means the Cabinet Secretary responsibleformattersrelating to agriculture;
"chief executive officer" means the person appointed in accordancewith section18;
"extension services"; means agricultural and livestock extension services; and
"county executive committee member" means the county executive committee member responsiblefor mattersrelatingtoagriculture.
3. The objects of this Act is to provide for a Objecs. framework-- 2. (a) tofostercoordinationandcollaboration in extension services research National Government, County Governments, nongovernmental organizations,learning institutions, research bodies and other non-state actors; 3. (b)topromotethegenerationofhighincomefor farmersandtradersthroughincreasedproduction and sourcing of competitive markets; 4. (c)for the continuous and sustained research on extensionservicesforthedevelopmentof the Agricultural and livestock industry; 5. (d)foradoptionofasector-wideapproachtothe provision extension serviceswhichenablesaccess

PARTII-NATIONALANDCOUNTY AGRICULTURALANDLIVESTOCKEXTENSION SERVICESPOLICYANDSTRATEGY.
4.(1) The Cabinet Secretary shall, formulate and publish inthe Gazette an agricultural andlivestock extensionservicespolicy atleast once everyfiveyears,for theimplementationandstandarddeliveryofextension services by the county governments.
(2)In developing theNational ExtensionServices Policy,the CabinetSecretary shall have regard to
- (a)the needfor an effective management and implementationstructureatthenational andcountylevelsofgovernmentinorderto ensuretheeffectivedevelopmentofthe extension services;
- (b)adequatecapacity development tby imparting skills,knowledge and practices insupport of playersin the extension servicessector;
- (c)the effective participationof stakeholders and communities at the national and county levels of government;
- (d)thedevelopment of appropriate strategies andmechanisms at the national and county levels of government necessary to support the development ofextensionservices;
- (e)the need tohave a mechanism tomonitor andevaluate theimplementationof the policyin the development and regulation of the extension services;
- (f) the resources required at the national and countylevelsofgovernmentforthe
National extension services policy.
effective implementation of the policy; and
- (g)thecapacitybuildingprogrammesand strategiesneededtobecarriedouttoensure thatextensionservicesproviders are ableto respondtotheneedsidentifiedforthe implementation of thepolicy.
(3)TheCabinetSecretaryshallperiodicallyreview theNationalAgriculturalandLivestock Extension Servicespolicy andmay,bynoticeinthe Gazette,publish arevisednationalagriculturalandlivestock extension services policy.
(4)The Cabinet Secretary,each county executive committeememberandallrelevantpublicbodiesshall, whenexercising orperforming anystatutoryfunction,take intoaccount andgiveeffecttothenational agricultural and livestockextensionservicespolicy.
5.(l) Each county executive committee member shall formulate andpublish,in the Gazette,a county specific extension services strategy.
(2)Informulating the strategy takeinto account the nationalagriculturalandlivestockpolicyformulatedbythe CabinetSecretaryundersection4.
(3)The countyexecutive committeemember shall periodicallyreviewthe countyagricultural andlivestock extensionservicesstrategy andmay,bynoticeinthe Gazette,publish a revised county agricultural and livestock extension services strategy.
PARTIII-THEAGRICULTURALAND LIVESTOCKEXTENSIONSERVICE
6.(1)There is established the Agricultural and LivestockExtensionService.
(2) TheServiceshallbe abodycorporatewith perpetual succession and a common seal and shall,in its corporate name,be capable of—
- (a) suing and being sued;
- (b) taking,purchasingor otherwise acquiring holding, charging and disposing of movable or

- (c) entering into contracts;
- (d) borrowing and lending money; and
- (e)doing or performing all such other things or acts asmaybenecessaryfortheproperdischargeofits functionsunder this Act,whichmay belawfully done or performed by a body corporate.
7. (l) The headquarters of the Service shall be in Nairobi.
- (2)The Service may establish such other offices effectiveperformanceofitsfunctionsunderthisAct.
- 8.(1) The functions of the Service shall be to—-
- (a)enhance the competitiveness ofthe agriculture and livestock industryinKenya in anincreasingly competitiveenvironment;
- (b)increase thelong-term productivity of agriculture and livestock industryinKenyawhile maintaining andenhancingthenaturalresourcebaseonwhich the national and county government's agricultural economy depend on;
- develop newuses and products for agricultural commoditiesanddevelopalternativeproduction methods for the production of new crops; and
- (d)improveriskmanagement in theagriculture and livestock industry in Kenya.
(2)In the performance of its functions under subsection (1),the Service shall—
- (a)support theprovision of agricultural research on extension 1servicestopromoteeconomic opportunitiesinruralcommunitiesandmeetthe demandforinformation andtechnologytransfer throughout the agriculture industry inKenya;
- (b) collaborate with county governments in——

Functions of the Service.
- (i)improving the coordination and planning ofagricultural research,extension and trainingprograms;
- (ii)identifying needs and establishing priorities for programs under subparagraph (i);
- (iii)realising theimplementation of national agricultural research, extension and training objectivesintherespective counties;and
- (iv) ensuring that the results of agricultural researchareeffectivelycommunicatedand demonstratedtousersincludingfarmers, processors, handlers, consumers who can benefit from them.
- (c)maintainanddisseminateinformationon standardsfor the supply ofnutritious and safe food by the county governments;
- (d) facilitate the transfer of technology;
- (e)encourage the use of information communication and technology by developing and packaging information in simple,easily accessible digital systems;
- f)collaboratewithinternationalentitiesinorderto leverage on resources, priority food and agricultural interests including addressing emerging plant and animal diseases, improving crop varieties and animal breeds and developing safe, efficient and nutritious food systems;
- (g)mobilise resources at the nationallevelof government for investment in development and implementation ofextensionserviceprograms in the counties;
- (h)develop and coordinateintergovernmental relationmechanismsinthedeliveryofservices
relatedtoextensionservices;
- (i) provide technical assistance and capacity building to the countygovernments onmatters relating to extension services;
- ()approveinstitutionsforthetraining ofextension services; and
- (k) establish, approve and accredit programs for continuingprofessional developmentprograms
- 9.The management of the service shall vest in the Board of Directors.
- 10.(1) The Board shall consist of ——
- (a)achairpersonwhoshallbeappointedbythe Cabinet Secretary;
- (b) the principal secretary responsible for matters relating to agriculture;
- (c)the principle secretary responsible for matters relatingtolivestock;
- (d)twopersonswith knowledge and experience in the field extension services nominated bythe Council ofCountyGovernors;
- (e)oneperson representing national farm or producer organizations nominated by the Council of County Governors;
- (f) one person representing the Kenya Agricultural and Livestock Research Organization nominated by the Organization;
- (g)one person representing theNational Association ofAgricultureandLivestockExtensionService Providersnominated by theAssociation;
- (h) onepersonrepresentingextensionservices training institutions nominated by theCabinet Secretary; and
- (i) the chief executive officer.
- (2) The Cabinet Secretary shall appoint the members under subsection (1) (a), (d), (e), (f), (g) and (h) by notice

(3)The chiefexecutive officer shallbe an ex officiomemberandsecretarytotheBoardand shallhavenoright tovote at anymeetingof the Board.
11.(l) A person is qualified for appointment as a member of the Board under section 10(1) (a),(e),(f), (g) and(h)ifthatperson—-
- (a) is a citizen of Kenya;
- (b)holdsa degreeinagricultureora relatedfield from a universityrecognized inKenya;
- (c) has at least three years' experience in management; and
- (d)meets therequirements of leadershipandintegrity set outin ChapterSixoftheConstitution.
(2)Aperson is notqualifiedfor appointment if that person--
- (a) is convicted of a criminal offence and sentenced to a termofimprisonment ofat leastsixmonths;
- (b)is a member of Parliament or county assembly; or
- (c)is adjudgedbankrupt.
12. A person who is appointed under section 10 shall serveforatermofthreeyearsrenewableforonefurther term.

Tenure appointment.
13. A person ceases to be a member of the Board if Vacation of office. that person-
- (a) is absent, without reasonable cause,for three consecutivemeetingsoftheBoard;
- (b) becomes an officer, agent or member of staff of the Board;
- (c)resigns by giving a notice in writing addressed to the Cabinet Secretary;
- (d)is convictedofa criminaloffence andsentenced toa termofimprisonmentofatleastsixmonths;
- (e) is declared bankrupt;
- (g)is unable to perform the functions of office by
reason of mental or physicalinfirmity; or
- (h) dies.
- 14.(1) The functions of the Board shall be to— Functionsofthe
- (a) make recommendations to the Cabinet Secretary and the ecounty governments on the implementation of strategies,plans and policies relatingtotheextensionservices;
- (b) advise the Cabinet Secretary and the County governmentsonPriorityareas ofExtension Service programs and the role of Non-state actors andotherExtensionServiceProvidersinlinewith the Policy;
- (c)evaluatetheresults sandeffectivenessof agriculturalresearch on extension,education,and economicswithrespecttothepoliciesand priorities andmake recommendationstothe Cabinet Secretary based on such evaluation;
- (d)reviewandmakerecommendationstotheCabinet Secretaryonthemechanismsneededfor agricultural extensiontechnology assessment and developmentforthepurposesof-
- (i)performancemeasurement andevaluation of theimplementation of theExtension services program in Kenya; and
- (ii) the development of mechanismsfor the assessmentofemergingpublicandprivate agriculturalresearch and technology transfer initiatives.
- (e) consult with industry groups on agricultural research,extension,education, and economics, andmakerecommendationstotheCabinet Secretary and the countygovernmentsbased on the consultation;
- (f) consult with any appropriate agencies and solicit opinions andrecommendations on persons who willbenefit from anduse nationallyfunded agricultural research,extension,education services;

- (g)establishlinkageswithlocalandinternational trainingandresearchinstitutionstoconduct scientificresearch and investigations in all areas pertainingto extensionservices;
- (h)coordinationofa agricultural researchby maintaining a continuinginventory of ongoing andcompletedextension andresearchprojects being conducted and funded by the government;
- (i)put in place a frameworkfor capacitybuilding and trainingofvariousplayersintheindustry;and
- (i)carry out such other functions as may be assigned by theCabinetSecretaryor conferredunderany other law.
(2)TheBoardshallconsultandcollaboratewiththe countyexecutivecommitteememberinthedevelopment, promotionandregulationoftheextensionservicesinthe respective counties.
15.(1) TheBoardmay establishsuch committees as it mayconsidernecessaryfortheefficientperformanceofits functions and theexerciseofitspowers under thisAct.
- (2)TheBoardmayco-opt anyperson tositina committee establishedunder subsection(1)suchpersons whoseknowledgeandskillsarefoundnecessaryforthe performanceofthefunctionsoftheBoard.
16.TheBoardmay,byresolution eithergenerally or in any particular case, delegate to any committee, member, officer,employee or agentof the Board,the exercise of anyofthepowersortheperformanceofanyofthe functionsof theBoardunderthisActorunderanyother writtenlaw.
17.Themembersof theBoardshallbepaidsuch remuneration,fees or allowancesas theCabinetSecretary shall,in consultationwith theSalariesandRemuneration Commission, determine.
18.(1)Thereshallbeachiefexecutiveofficerofthe Boardwhoshallbe competitivelyrecruited and appointed bytheBoardonsuchtermsandconditionsastheBoard shall determine.
(2) A person is qualified for appointment as the chief Committeesof the Board Delegation by the Board.

- (c)has atleast ten years'experience insenior management; and
- (d)meets therequirements of leadership andintegrity set outin chaptersixoftheConstitution.
(3) The chief executive officer shall hold office for a term of fiveyears and is eligiblefor re-appointmentfor onefurtherterm.
19.The chiefexecutive officershall be the secretary to the Board and shall, subject to the direction of the Board--
- (a)beresponsiblefor the dayto daymanagement of the affairsof theBoard;
- (b) manage the funds, property and affairs of the Board;
- (c)beresponsible for the management of the staff of the Board;
- (d)oversee and coordinate theimplementation of the policies, programmes and objectives of the Board;
- (e)causetobepreparedfor theapprovalof the Board-
- (i) the strategicplan and annual plan of theBoard; and
- (ii) the annual budget and audited accounts of the Board; and
- (f) perform such other duties as may be assigned by the Board.
20.The chiefexecutive officer shallcease tohold officeif thatperson——

- (a) resigns in writing, addressed to the Board;
- (b)is convictedofa criminaloffenceandsentenced toatermofimprisonmentofnotlessthansix months;

- (c)is found liable for gross misconduct or abuse of officeincontraventionofanywrittenlaw;
- (d) is declared bankrupt;
- (e)is unable toperform the functions of office by reasonofmentalorphysicalinfirmity;or
- (f) dies.
21.(1) The Board may employ such officers, agents and staff as are necessary for the proper and efficient dischargeofthefunctionsoftheBoardunderthisActand upon such terms and conditions of service as the Board may determine.
StaffoftheBoard.
(2) The persons appointed under subsection (1) shall becompetitivelyrecruitedandappointedbytheBoardand shall serve onsuch terms and conditions as theBoard may, inconsultation withtheSalaries and Remuneration Commission determine.
(3) The staff appointed under subsection (l) shall possesssuchknowledgeandexperienceasshallbe determinedbytheBoard.
22.Liabilityshallnot attachtotheBoardor toanyof its members, officers, agents or staff for loss or damage incurred by a person as a result of an actor omission done ormade ingood faith and without negligence in the performanceorexerciseortheintendedperformance or under thisAct.
23.(1)The commonsealoftheBoardshallbekeptin thecustodyofthechiefexecutiveofficerorsuchother person as the Board may direct, and shall not be used exceptupontheorderoftheBoard.

(2)ThesealoftheBoardshall be authenticatedby the signature of the chief executive officer and the chairperson or aperson designated by theBoardfor thatpurpose on behalfofthechairperson.
24. All letters and instruments written or made by or Signing authority. onbehalfoftheBoard,otherthanthoserequiredbylawto beunder seal,and all decisions of the Board,shall be signedunder the hand of the chief executive officer orin the absence of the chief executive officer,a person
authorizedbytheBoard.
25.(1) The business and affairs of the Board shall be conducted in accordance with the provisions set out in the Schedule.
(2)Except as otherwise provided in the Schedule,the Boardmayregulateitsownprocedure.
(3) The Board may invite any person to attend any of itsmeetings and toparticipateinits deliberations,butsuch personshall notbeentitled tovoteon anyof theBoard's decisions.
PARTIV-ROLEOFCOUNTYGOVERNMENTS
26. (1) Each county government shall— 2. (a)implement theNational Governmentpolicy and standardsrelatingtotheextensionservices; 3. (b)regulateandpromoteextensionserviceswithin the respective county; 4. (c)collect,collateanddisseminateinformationon extensionservicesincludingtheappropriate technologyandpracticestoensuremaximisation of yields and sales by stakeholders; 5. (d) coordinate the activities of persons, organisations andanyotherassociationswithinthefieldof extension services; 6. (e) facilitate access by players in the extension servicesto such resources and financial support as maybe necessary to promote the use and developmentofextension 1servicesinthe respective county;and 7. (f)improve on the safe production and processing of, andaddingofvalueto,Kenyanfoodandfibre resourcesusingmethodsthatmaintainthebalance betweenyieldandenvironmentalsoundness.
(2)Each county executive committee member shall, in ensuring that the county government fulfils its obligations under subsection (1) -
- (a)maintainanuptodateregisterofextension

- (b) consider applications forregistration and licences;
- (c)carry out surveillance and inspections to ensure compliancewith the standards and legislation on the extensionservices;
- (d)promote the organisation of all players in thefield ofextension services;
- (e)provide training onextension serviceprograms anddisseminateinformationtostakeholderson entrepreneurialandothertechnicalskills and values,attitudeformationandsocio-economic development strategies;
- (f) collaborate with relevant institutions soas to promoteaccesstocreditandother financial services; and
- (g)carry out such other functions as may be conferred upon by any law.
- 27.(1)Acounty public service board shall competitivelyrecruitandappointsuchextensionservices officersasitmayconsidernecessaryfortheproperand efficientimplementationofthisAct.
- (2) In recruiting the extension services officers under subsection(1),the county service board shallensurethatsufficientofficersarerecruited and deployed at the grassroot level.
- (3)Eachcountygovernmentshallprovidethe necessaryinfrastructure andfundsnecessaryfor theimplementation of extension serviceswithin the county.
28.(1) A person is qualified for employment as an extensionservicesofficerifthepersonholdsacertificate in anextensionservices related coursefrom a tertiary institution recognized in Kenya.
(2)A County government may through legislation, prescribeadditionalqualificationsasitmaydeem necessary.
- 29.(1)Anextensionservicesofficer or aprivate

Qualificationfor extensionservices officers.
Registration of entity thatintends toprovide extension services,shall registerwiththerespectivecountygovernmentinwhich theyintend toprovide theservices.
- (2)An extension service officer or private entity shall furnishtheofficerappointedunder section30(3)with change of details within seven days of the occurrence of the change.
- 30.(1) Each county executive committee member shall keep and maintain a register of—
- (a) extension service officers registered Iinthe respectivecounty;and
- (b)private entities providing extension services in the respective county.
- (2) The register under subsection (l) shall include thefollowing
(a) in the case of an extension service officer-
- (i) name
- (ii)identification details as per the identification document;
- (iii)contact details;
- (iv)qualifications;
- (v)information on current status of employment; and
- (vi)such other information 1as sthecounty executive committee member shall prescribe in county legislation.
(b)in the case of a private entity-
- (i) name of the entity;
- (ii)number anddetails of extensionofficers employed by the entity;
- (ii)area of specialty; and
extension services officers.

- (iv)locationoftheofficeheadquartersand branches if any.
3 The Countyexecutivecommitteemember shall designate apublicofficerwithin the countypublic service asaregistrartokeepandmaintaintheregister under subsection (1).
31.(l)Each county executive committeemember shall publish on a website maintained by the county government and on such other platform as the committee membermayconsider appropriate,informationon the—
- (a) extension services available in the county; and
- (b)extension 1servicesofficers delivering the services within the county.
- (2)The information published under subsection (1) shall include-
- (a)emerging pest and diseases that may affect crops and livestockin the county;
- (b) the major challenges faced by farmers and the action requiredtopreventormitigatesuchchallenges;
- (c)thepreventive andcurativemeasures availabletothe farmers;
- (d)informationaboutresourcesavailabletosupport farmerswithin the County;and
- (e)suchotherinformationrelatingtoextensionservices thatthecountyexecutivecommitteemembermay consider necessary.
(3)Theinformationunder subsection(1)shallbe accessibletotheresidentsofthecountyandshallbepublished in a format that is easy to understand.
PARTV-FINANCIALPROVISIONS
Publicizing extensionservices
- 32.Thefundsof theService shall consist of
- (a) moniesappropriatedbyParliamentforthe purposes ofthe service;
- (b) such monies or assets as may accrue to or vest in theserviceinthecourseoftheexerciseofits powersor theperformanceofitfunctionsunder thisAct oranyotherwrittenlaw;and
- (c) donations, grants, loans or gifts made to the service and approvedby theCabinetSecretaryfor finance.
- 33.(1)Atleastthreemonthsbeforethe commencement of each financial year,the Board shall causetobepreparedestimatesof therevenueand expenditureoftheBoardforthatyear.
(2) The annual estimates shall make provision for all estimatedexpenditureoftheBoardforthefinancialyear concerned.
(3)The annual estimates prepared by the Board under subsection(2)shall besubmitted to theCabinetSecretary for tablingintheNationalAssembly and theSenate.
34.(1) TheBoard shall cause to bekept such books of accounts and other books in relationtheretoof all its undertakings, funds, activities and property as the Cabinet Secretary may from time to time approve and shall, within a period of three months after the end of the financial year, cause tobeprepared,signed andforwarded totheAuditorGeneral-
- (a)a balance sheet showing in detail the assets and liabilitiesoftheBoard;and
- (b) such other statements of accounts as the Cabinet Secretary may approve.

(2) The accounts of the Board shall be examined, audited andreportedupon annuallybytheAuditor-General inaccordancewiththePublicAuditAct.
(3)TheBoardshallsubmit to theAuditor-General all books andaccounts of the Board,together with all vouchers in support thereof, and all books, papers and writings in its possession or control relating thereto,and Funds softhe Service.

35.(1)The Board shall,within a period of three months after theendofeachfinancialyear orwithinsuch longer period as the Cabinet Secretary may approve, submit to theCabinetSecretaryareportoftheoperations of the Board during such year,and the annualbalance sheet andsuchother statementsofaccountas theCabinet Secretary shall require, together with the AuditorGeneral's report.
(2) The Board shall, if the Cabinet Secretary so requires,publish the report,balance sheet and statements submitted under subsection(1) in such manner as the Cabinet Secretary may specify.
(3)The CabinetSecretary shall submit to theNational Assembly and the Senate the reports,balance sheet and statements submitted under subsection (1),within a period offourteendaysof thereceiptof thereportsand statements.
36.The financialyear of the service shall be the period of twelve months ending on the thirtieth of June in each year.
PARTVI-MISCELLANEOUSPROVISIONS
37.Each county government may enact county specificlegislation setting out-
- (a) the criteria for the registration of extension services providers within the respective county;
- (b) criteria for the issuance of a licence to an applicant within the respective county;
- (c) information required to be submitted by an applicantforregistration orissuance ofa licence;
- (d) process of determination of an application for registration or issuance of a licence;

- (e)theconditionsfor theissuanceorrenewalof a licence under this Act;
- (f) the grounds for the rejection of an application or cancellation of a licence issued under this Act; and

38.Apersonofferingextension services shall adhere tosuch procedures, standards, code of ethics and guidelines as maybe prescribed under this Act or any other written law.
39. (1)The Cabinet Secretary may, on recommendation oftheService and thecounty governments, make regulations for or with respect to any matter which is necessary or expedient tobe prescribedfor carryingoutorgivingeffecttothisAct.
- (2)Withoutprejudicetothe generalityof subsection (l),the Cabinet Secretary may prescribetheminimumstandardswithregardto the-
- (a)training of extension services officers;
- (b) professional qualifications of extension services officers;
- (c)certification and registration with respect to extension services;and
- (d)remuneration 1ofextensionservices officers.

PROVISIONSRELATINGTOTHECONDUCTOF BUSINESSANDAFFAIRSOFTHEBOARD
1.(1) TheBoard shallhave at least sixmeetings in everyfinancialyearandnotmorethantwomonthsshall elapsebetweenthedateofonemeetingandthedateofthe nextmeeting.
(2)Meetingsshallbeconvenedbythechiefexecutive officerinconsultationwiththechairpersonandshallbe held at such times and such places as the chairperson shall determine.
(3)The respective chairpersons shall preside over all meetings and in the absence of the chairperson,by a person electedbytheBoard as thecasemaybe at themeetingfor thatpurpose.
(4)Thechairpersonmayatany timeconvenea special meeting of the Board as the case may be,and shall do so withinonemonthofthereceiptbythechairpersonofa writtenrequestsignedbyatleastfiveothermembers.
(5)Unless half of the members of theBoard otherwise agree,at least seven days'notice of a meeting shall be given to every member of the Board as the case may be.
2. The quorum of a meeting of the Board is half of the Quorum. totalnumberofmembers.
3.A decision of the Board shall be by a majority of Voting. the members present and voting and,in the case of an equality ofvotes;the person presiding at the meeting shall haveasecondorcastingvote.
4.Minutes of all meetings shall bekept and entered in records kept for that purpose.
5.(1) If a person is present at a meeting of the Board orrespectivecommittee atwhichanymatteristhesubject ofconsiderationandinwhichmatterthatpersonisdirectly orindirectlyinterestedin aprivatecapacity,thatperson shallassoonasispracticableafterthecommencementof the meeting,declare such interest.
(2) The person making the disclosure of interest under subsection(1)shallnot,unlesstheBoardor committee Minutes.

otherwise directs, take part in any consideration or discussion of, or vote on any question touching on the matter.
(3) A disclosure of interest made under subsection (1) shall berecordedintheminutes of themeeting atwhich it ismade.
(4)A personwho contravenes subsection(l) commits anoffenceandupon convictionisliabletoafinenot exceeding five hundred thousand shillings or to imprisonmentfora termnotexceedingsevenyearsor to bothsuchfine and imprisonment.
(5)Amemberoremployeeof theBoardshallnot transact anybusiness or tradewiththeBoard.
